The Ontario Court of Appeal dismissed the appeal from a summary judgment ordering the appellants, 2562583 Ontario Inc. o/a Meltwich Food Co. and Janarthanan Jeyaparan, to indemnify the franchisor, Meltwich Hospitality Group Inc., for amounts paid to the landlord, Ritson Division Retail GP Limited, following the franchisee’s breach of a commercial lease.

The court upheld the motion judge’s findings that the franchisee’s breach triggered indemnity obligations under the franchise and assignment agreements, and that the settlement between the franchisor and landlord was reasonable.

The appellants’ arguments regarding the scope of indemnity, timing of liability, and procedural fairness were rejected.

The appellant, Preston Woods, appealed his 7-year sentence for drug offences on the basis that the sentencing judge erred by refusing to adjourn the sentencing hearing to allow him to obtain records of time spent in lockdown during pre-sentence custody.

The Court of Appeal found that the sentencing judge erred in principle by not allowing the adjournment, which prevented consideration of a possible sentence reduction (Duncan credit) for harsh pre-sentence conditions.

The Court allowed the appeal, admitted the lockdown records as fresh evidence, and substituted a sentence of 6 years and 9 months.

The appellant, Zachary Wittke, sought a fresh psychiatric assessment under section 672.11 of the Criminal Code, arguing that it would demonstrate psychiatric disorders relevant to his mens rea for murder.

The Court of Appeal dismissed the motion, finding that a prior assessment at trial already addressed these issues and that no new evidence justified a further assessment.

The court held that strategic decisions at trial and the absence of new or flawed evidence did not warrant a new assessment at the appeal stage.

The appellant, Ahmed Ali Debouk, appealed his convictions for extortion, uttering death threats, criminal harassment, and breaching a non-communication condition, arguing his guilty pleas were involuntary due to pre-trial detention pressures and that his Charter rights were violated by non-disclosure of a voice mail recording.

The Court of Appeal found no merit in either ground, holding that the pleas were voluntary, unequivocal, and informed, and that there was no evidence of non-disclosure or prejudice.

The appeal was dismissed.

The Court of Appeal for Ontario dismissed Adam Picard’s appeal from his conviction for first degree murder.

The court found that the trial judge did not err in excluding Picard’s prior consistent statements to his first lawyer, in instructing the jury on constructive first degree murder, or in the adequacy of the jury charge.

The decision provides a detailed analysis of the law on prior consistent statements, the requirements for constructive first degree murder under s. 231(5) of the Criminal Code, and the sufficiency of jury instructions in complex homicide cases.

The appellant, Kyle Watson, appealed his sentence for robbery and failure to comply with a release order.

The Court of Appeal for Ontario granted leave to appeal but ultimately dismissed the appeal, finding no error in the sentencing judge’s application of the principles of restraint and consideration of the harsh conditions of pre-sentence custody.

The sentencing judge had taken into account the appellant’s Indigenous identity, personal history, and the conditions of pre-sentence custody, and provided appropriate credit for time served.

The sentence imposed was found to be within a reasonable range given the circumstances.

The Court of Appeal for Ontario considered the appeals of Rushawn Anderson and Nicholas Rhoden from convictions for attempted murder and aggravated assault.

The appellants argued that the trial judge erred in admitting out-of-court statements, in his rulings on Charter violations, in instructing the jury on fabrication, and that the verdicts were unreasonable.

The majority dismissed the appeals, finding the fabrication instruction sufficient and the verdicts reasonable.

In dissent, Gomery J.A. would have allowed the appeals, finding the fabrication instruction flawed and the verdicts unreasonable, and would have substituted acquittals.

The Court of Appeal for Ontario considered an appeal by Peter Tak Ming Lee and Mun Chung Leung from a judgment granting York Region Standard Condominium Corporation No. 972 possession of their unit and leave to issue a writ of possession, unless the appellants discharged a lien.

The appeal raised issues of trial judge bias, disregard of evidence, and the validity and calculation of the lien.

The court rejected the bias and evidentiary grounds, but found a calculation error in the lien amount, requiring a reduction.

The appeal was allowed in part, with no order as to costs.

The appellants, Jordan Rudiger Zukowski and Rudi Heinz Edwin Zukowski, appealed an order granting summary judgment to the respondent, MarshallZehr Group Inc., regarding the enforceability of a personal guarantee for a project financing loan.

The Court of Appeal dismissed the appeal, finding no error in the motion judge’s refusal to permit cross-examination of the respondent’s representative and no reviewable error in the finding that the respondent did not act in bad faith.

The court held that the issues raised were properly resolved on the record and that the personal guarantee was valid and enforceable.

The Court of Appeal for Ontario allowed the appeal of J.P. Thomson Architects Ltd., holding that the application judge erred in interpreting the dispute resolution clause (GC18) in the parties’ contract.

The Court found that GC18 did not require mediation to be sought within 30 days of a dispute arising, but rather set a minimum 30-day period for informal resolution before mediation could be requested.

The Court also held that the application judge erred by making findings about the scope of the parties’ dispute, which should have been left to the arbitrator.

The Court ordered mediation to proceed within 60 days, with the right to seek arbitration preserved.

The Court of Appeal for Ontario dismissed the appeal by the appellants, finding no palpable and overriding error or extricable legal error in the motion judge’s interpretation of minutes of settlement incorporated into a court order.

The court held that the motion judge correctly applied contractual interpretation principles, considered the relevant factual matrix, and properly refused to rely on subjective and contradictory evidence.

The appellants’ argument regarding severance of joint tenancy was rejected.

Costs of $8,000 were awarded to the estate.

The Court of Appeal for Ontario dismissed the appeal of Gavin Bertsch from the Superior Court’s dismissal of his wrongful dismissal action against Datastealth Inc. The court upheld the enforceability of the employment agreement’s termination provision, which limited Bertsch’s entitlements on termination to the minimum requirements under the Employment Standards Act, 2000 (ESA).

The court found the clause to be unambiguous and compliant with the ESA, precluding any claim for common law damages.

Costs of $10,000 were awarded to the respondent.

The Court of Appeal for Ontario dismissed the appeal of Carmela and Vincenzo Di Trapani from a costs order made after an 18-day civil jury trial regarding injuries sustained by William “Bill” Pye in a 2016 motor vehicle accident.

The trial judge awarded Pye costs of $995,854.50 and prejudgment interest at 3%.

The appellants argued the trial judge failed to scrutinize fees and disbursements, did not apply reasonableness and proportionality, and erred in awarding a higher prejudgment interest rate.

The Court of Appeal found no error in the trial judge’s approach, holding the costs and interest rate were reasonable and supported by the record.

The Court of Appeal for Ontario dismissed Jason Immel’s conviction appeal for possession of fentanyl for the purpose of trafficking and possession of proceeds of crime, finding no error in the trial judge’s reasoning or assessment of the evidence.

The court allowed the sentence appeal in part, reducing the sentence for possession of proceeds of crime to the statutory maximum of two years, concurrent with the fentanyl sentence, but otherwise upheld the global sentence.

The Court of Appeal for Ontario dismissed the appeal of Aliamisse O. Mundulai from a final order in a family law dispute with Ying Huang.

The appeal concerned parenting, property, and financial issues following the parties' separation.

The court found no reversible error in the trial judge’s decisions regarding the child’s therapy, beneficial ownership of an office unit, and the treatment of the respondent’s pension for equalization purposes.

Costs were awarded to the respondent.

The Court of Appeal for Ontario dismissed the Law Society of Ontario’s appeal regarding the respondent’s application for licensure as a paralegal.

The court found that the tribunals below properly considered the respondent’s criminal offence and professional misconduct, and that there was no error in their assessment of her rehabilitation and good character.

The appeal was dismissed with costs to the respondent.

The Court of Appeal for Ontario dismissed Shantanu Shirodkar’s appeal seeking to certify a class action against Coinbase Global, Inc. and its subsidiaries for alleged violations of securities laws.

The court upheld the motion judge’s findings that Ontario courts lacked jurisdiction over the non-Canadian Coinbase entities and that Ireland was the preferable forum for the claims, staying the action against Coinbase Canada as well.

The decision addresses the interpretation of forum selection clauses, the application of the “real and substantial connection” test, and the doctrine of forum non conveniens in the context of cross-border crypto-asset trading.

The Court of Appeal for Ontario dismissed the appeal of Dianne Pearl Douglas from a final order in a family law proceeding concerning parental decision-making, parenting time, and child support.

The appellant argued that the motion judge erred in finding a material change in circumstances and in determining that the respondent’s parenting time met the 40% threshold under the Federal Child Support Guidelines.

The Court found no error in the motion judge’s findings or application of the law, upholding the retroactive adjustment to child support and awarding costs to the respondent.

The Court of Appeal for Ontario dismissed the appeal of Matthew James Avery from an uncontested trial order requiring him to pay child support, s. 7 expenses, and granting a vesting order for sole title to the matrimonial home to Angela Nadine Wade.

The court found no exceptional circumstances to justify hearing the appeal, no error in the trial judge’s exercise of discretion, and that the appellant had adequate notice of the relief sought.

The court also held that the absence of evidence of the current value of the home did not result in injustice, particularly given the appellant’s failure to participate or provide disclosure.

This is an appeal from an order of the Superior Court of Justice regarding a motion to vary parenting and support arrangements between the parties, parents of two children.

The appellant challenged 20 provisions of a comprehensive order, but the Court of Appeal found no basis for intervention.

The court upheld the motion judge’s findings of a material change in circumstances, the revised parenting schedule, the calculation of child support, the imputation of income, and the costs award.

The appellant’s motion to introduce fresh evidence was also dismissed.
