This appeal concerns the costs consequences of protracted family law litigation between K.K. (the husband) and M.M. (the wife).

The Court of Appeal addresses whether the trial judge erred in awarding full recovery costs to the wife, staying prior costs orders made in favour of the husband, and whether there was a reasonable apprehension of bias.

The majority upholds the trial judge’s costs award and the stay of prior costs orders, finding exceptional circumstances due to the husband’s bad faith.

A dissent would reinstate the stayed costs orders, holding that the trial judge exceeded her authority under s. 106 of the Courts of Justice Act.

The Ontario Court of Appeal dismissed the appeal of Robert Paul Ireland from a judgment declaring his Facebook posts defamatory of the Ontario Federation of All Terrain Vehicle Clubs, ordering their removal, and enjoining further defamatory posts.

The court found no procedural unfairness or error in the application judge’s decision, holding that Mr. Ireland’s failure to file a notice of appearance precluded him from participating in the application, and that the Federation’s courtesy in providing him with information did not create further obligations.

The court also rejected arguments regarding service and limitations, and found no reviewable error in the application judge’s findings on defamation and available defences.

The Court of Appeal for Ontario dismissed the appeal of Vahid Mehdizadeh Asiyaban and 2468692 Ontario Ltd. against Halime Khatoun Aghdasi.

The trial judge had found that the appellant falsified evidence and solicited false testimony in support of a property claim in family litigation.

The Court held that the trial judge was entitled to reject the appellant’s uncorroborated evidence and found no basis to interfere with the credibility findings.

The appeal was dismissed in its entirety, and the appellant was ordered to pay costs to the respondent.

The appellant, Igor Kononenko, appealed his conviction for sexual assault.

The Court of Appeal reviewed the trial judge’s treatment of prior consistent statements, the use of the complainant’s out-of-court utterances, and the application of the W.(D.) framework.

The court found no error in the trial judge’s approach to the evidence or reasoning, and dismissed the appeal.

Following a decision dismissing the appeal and allowing the cross-appeal to set aside a partial certification order, the Court of Appeal for Ontario determined the costs of the certification motion below.

The successful defendants sought $232,005.93 in costs, while the plaintiffs argued that a fair award would be between $125,000 and $150,000.

After reviewing the submissions and the bill of costs, the court awarded the defendants partial indemnity costs of $190,000, all inclusive.

The court found this amount to be fair and reasonable given the complexity, importance, and novelty of the issues involved in the certification motion.

The appellant, Jason Windebank, appealed his designation as a Dangerous Offender and the imposition of an indeterminate sentence following convictions for violent offences against his domestic partner.

The Court of Appeal for Ontario dismissed the appeal, finding that the sentencing judge’s errors were immaterial, that Gladue principles were sufficiently considered, and that the judge properly exercised her discretion in imposing an indeterminate sentence.

The Court of Appeal for Ontario granted the Crown’s application to revoke the respondent’s bail pending retrial on historical sexual offences.

The court found that the motion judge erred in law by concluding that the release order was a nullity due to a typographical error referencing the wrong provision of the Criminal Code.

The error was deemed minor and not prejudicial.

The respondent’s breach of a condition prohibiting contact with children under 16 was established, and the release order was revoked.

The Court of Appeal for Ontario dismissed the appeal by Temagami Barge Limited and Dashiel Lowery Delarosbel from an order restraining their use of property for 13 uses found to contravene municipal zoning by-laws.

The court upheld the application judge’s findings on legal non-conforming use, the treatment of expert evidence, and the appropriateness of proceeding by application.

The court also found no error in the award of costs to the municipality, noting that leave to appeal costs was not sought as required.

Costs of the appeal were fixed at $25,000 to the municipality.

The Court of Appeal for Ontario dismissed the appeal of Albert Edward Green from the order of Justice John Krawchenko regarding the division of property and spousal support following the breakdown of his marriage to Kristine Jill Hill.

The court upheld the trial judge’s findings on asset valuation, the application of the Family Law Act’s equalization mechanisms, and the denial of spousal support, finding no error in the trial judge’s approach or conclusions.

Costs of $35,000 were awarded to the respondent.

The appellant, Mustafa Ahmed, was convicted of second degree murder following a judge-alone trial.

The case involved a fatal shooting during a bar altercation, captured on CCTV.

The trial judge rejected Ahmed’s claims of self-defence and provocation, finding his testimony not credible or reliable.

On appeal, Ahmed argued that the trial judge made palpable and overriding errors in assessing the CCTV evidence and misapplied the law regarding his subjective beliefs.

The Court of Appeal found no such errors and dismissed the appeal.

The appellant, Leslie Arthur Swan, appealed the dismissal of his claim for conspiracy and defamation against several respondents, including a condominium corporation, its manager, and legal counsel.

The motion judge dismissed the action as frivolous, vexatious, and an abuse of process under rule 2.1.01 of the Rules of Civil Procedure, finding it was a collateral attack on earlier proceedings and statute-barred.

The Court of Appeal upheld the motion judge’s decision, finding no error and dismissing the appeal with costs to the respondents.

The Law Society of Ontario (LSO) appealed a Divisional Court decision that quashed its administrative decision to void the registrations of 20 licensing candidates implicated in a cheating scandal.

The Divisional Court had found the LSO breached procedural fairness by not holding oral hearings before voiding the registrations.

The Court of Appeal allowed the appeal, finding that the Divisional Court misapplied the Baker factors and conflated the LSO's administrative licensing functions with its disciplinary good character functions.

The Court held that the written process provided by the LSO, which included disclosure and multiple opportunities to respond, satisfied the duty of procedural fairness.

The Court also admitted new evidence and found the Divisional Court breached procedural fairness by making costs orders without allowing submissions.

The appellant, William Gillen, appealed his convictions for trafficking fentanyl, possession of fentanyl and cocaine for the purpose of trafficking, and possession of proceeds of crime.

The appeal focused on the trial judge’s instructions to the jury, specifically whether the judge usurped the jury’s fact-finding role, encouraged propensity reasoning, or permitted the jury to use text messages for a prohibited purpose.

The Court of Appeal found no error in the trial judge’s instructions and dismissed the appeal.

The Court of Appeal for Ontario denied the Crown's application for leave to appeal a Provincial Offences Appeal Court (POAC) decision upholding the City of Greater Sudbury's acquittal on charges under the Occupational Health and Safety Act.

The case arose from a fatal workplace accident involving a road grader operated by a contractor.

The court found that the trial judge and POAC judge properly applied the due diligence defence and that the issues raised by the Crown did not meet the high threshold for a second-level appeal.

The decision clarifies the application of due diligence in occupational health and safety prosecutions, emphasizing that such defences must be directed at the specific violations alleged and that findings of control are primarily factual.

The Court of Appeal for Ontario allowed the appeal of P.P. from convictions for assault, sexual assault, uttering threats, unlawful confinement, and attempted extortion, setting aside the convictions and ordering a new trial.

The court found that the trial judge made errors by relying on unsupported assumptions about arranged marriages, improperly relying on an evidentiary fact without giving counsel an opportunity to make submissions, and drawing conclusions based on government COVID protocols without evidentiary foundation.

These errors rendered the convictions unsafe.

The Court of Appeal for Ontario allowed J.C.'s appeal from a dangerous offender designation and indeterminate sentence, finding a miscarriage of justice due to the limited, non-adversarial role assigned to amicus curiae at the original hearing.

The Court held that, in light of subsequent Supreme Court guidance in R. v. Kahsai, the trial judge erred in principle by not appointing amicus with a broader, adversarial mandate to ensure fairness, given the appellant's self-represented and self-defeating position.

The Court ordered a new hearing.

The Court of Appeal for Ontario dismissed the Crown's appeal from a stay of proceedings granted due to a breach of the respondents’ rights under section 11(b) of the Charter.

The court agreed with the trial judge that last-minute offering of earlier trial dates did not require defence counsel to be available, nor did it make any resulting delay attributable to the defence.

The court also found the case was not sufficiently complex to justify an exception to the Jordan framework, and the presence of a Garofoli application did not elevate the case’s complexity.

The Court of Appeal for Ontario dismissed the conviction and sentence appeals of Habibullah Daniel Ahmadi, who was convicted of second degree murder for the fatal assault of Sara Anne Widholm.

The appeal focused on whether the trial judge erred in using Ahmadi’s out-of-court statements as circumstantial evidence of guilt, failed to consider critical evidence on intent, and improperly relied on after-the-fact conduct.

The Court found no legal error in the trial judge’s treatment of the evidence, including the assessment of intoxication and intent, and upheld the 13-year parole ineligibility period.

The appellant appealed a judgment of the Ontario Superior Court of Justice that recognized a Belgian judgment obtained against it by the respondent's liquidator for unpaid textile invoices.

On appeal, the appellant sought to introduce fresh evidence regarding service of the foreign writ and alleged ineffective assistance of counsel.

The Court of Appeal for Ontario rejected the fresh evidence, noting it could have been presented below, and held that ineffective assistance of counsel is generally not a ground of appeal in civil matters.

Consequently, the court found no error in the application judge's decision to recognize the foreign judgment and dismissed the appeal.
