Following a decision dismissing the appeal and allowing the cross-appeal to set aside a partial certification order, the Court of Appeal for Ontario determined the costs of the certification motion below.
The successful defendants sought $232,005.93 in costs, while the plaintiffs argued that a fair award would be between $125,000 and $150,000.
After reviewing the submissions and the bill of costs, the court awarded the defendants partial indemnity costs of $190,000, all inclusive.
The court found this amount to be fair and reasonable given the complexity, importance, and novelty of the issues involved in the certification motion.
