The Court of Appeal for Ontario dismissed Kenneth Reed's appeal from a summary judgment in favour of the Bank of Nova Scotia regarding two lines of credit for his farming operation.

The court found that summary judgment was appropriate, the Consumer Protection Act did not apply as Reed was not a consumer, and a stay under the Farm Debt Mediation Act did not apply to the appeal itself but did stay enforcement of the judgment pending mediation.

Costs of $7,500 were awarded to the Bank.

The Court of Appeal for Ontario dismissed the appeal concerning the interpretation of a will provision granting an option to purchase a townhouse.

The court upheld the application judge’s finding that the option was properly exercised within the required time and that the will’s terms were sufficiently certain.

The court also rejected arguments regarding the necessity of a separate agreement of purchase and sale and the relevance of the parties’ subsequent conduct.

Costs were awarded as agreed.

The Court of Appeal for Ontario dismissed the appeal of Kyrle Blake Farmer, who had served as estate trustee and attorney for property for his aunt, Billie Frances Farmer.

The respondents, his brothers, challenged his distributions and expenses.

The application judge found that Billie lacked capacity to provide instructions, that the appellant’s compensation and expenses were not justified, and that he failed to keep proper accounts.

The appellant was ordered to repay significant sums to the estate.

The Court of Appeal found no error in the application judge’s findings or orders and dismissed the appeal with costs.

The Court of Appeal for Ontario dismissed the appeal in this commercial landlord-tenant dispute.

The trial judge found that the tenant, 2682543 Ontario Inc., repudiated the lease for restaurant premises and that the landlord, 720443 Ontario Inc., properly accepted the repudiation and terminated the lease.

The tenant and its guarantor, Shahab Rashid Savojbolaghi, were held liable for damages.

The Court rejected the tenant’s arguments regarding joint occupancy and the timing of possession, upholding the trial judge’s interpretation of the lease and the finding of repudiation.

The Court of Appeal for Ontario dismissed the appeal of the Amalgamated Transit Union, Local 1587, upholding the Divisional Court’s decision to quash an arbitration award that reinstated five employees dismissed by Metrolinx for sexual harassment.

The Court found that the arbitrator made legal and factual errors, including failing to recognize Metrolinx’s statutory duty to investigate workplace harassment even in the absence of a formal complaint, and improperly relying on myths and stereotypes about victim behaviour.

The matter was remitted to a new arbitrator for reconsideration.

This addendum to the Court of Appeal for Ontario’s decision in Hillier v. Ontario addresses the appropriate constitutional remedy for unjustified limits on peaceful assembly rights under the Charter during the COVID-19 pandemic.

The court discusses the principles of “reading in” and “reading down” as remedial tools, ultimately preferring reading down the impugned regulations to exclude peaceful outdoor protests of up to 10 people from the prohibition on gatherings.

The court’s approach is guided by Supreme Court authority and the need to respect legislative intent while vindicating Charter rights.

The moving party, Deerbourne Estates Corporation, sought an order extending the time to file a motion for leave to appeal a costs award of $78,855.83 made against it in a mortgage action.

The Court of Appeal for Ontario applied the test for an extension of time, noting that while the moving party intended to appeal, it provided no explanation for its delay.

Furthermore, the court found that the proposed appeal lacked merit because costs awards are highly discretionary and the moving party failed to demonstrate any error in the motion judge's decision.

Consequently, the court dismissed the motion to extend the time to file the motion for leave to appeal.

The Court of Appeal for Ontario allowed Norma Walton’s appeal from her convictions for theft over $5,000, finding that the trial judge’s repeated and intrusive questioning of the accused during her testimony, both in chief and in cross-examination, undermined the fairness of the trial.

The court held that the trial judge’s interventions usurped the role of counsel, created the impression of alignment with the Crown, and prevented the defence from presenting its case in an orderly fashion.

A new trial was ordered.

This addendum to the judgment in McKenzie-Barnswell v. Xpert Credit Control Solutions Inc., 2025 ONCA 253, clarifies issues regarding post-judgment interest, costs, and the status of the mortgage at issue.

The Court of Appeal for Ontario confirms that post-judgment interest is to be calculated at the statutory rate under the Courts of Justice Act, not the rate in the mortgage, due to findings of unconscionability and wrongful conduct.

The court upholds the trial judge’s substantial indemnity costs award, orders a set-off of costs against the respondent’s indebtedness, and confirms that the unconscionable mortgage shall not be re-registered.

Monies paid into court as security for costs are to be paid out to the appellants’ lawyers in trust.

The Court of Appeal for Ontario dismissed the appeal of Shahin Songhorigakien from a summary judgment ordering her to pay $500,000 plus interest and costs to the Bank of Montreal under a personal guarantee for a corporate overdraft facility.

The court found no error in the motion judge’s conclusion that there was no genuine issue requiring trial, that the bank owed no special duty to Songhorigakien, and that her non est factum defence had no air of reality.

The court also rejected arguments of procedural unfairness.

The Court of Appeal for Ontario allowed both the appeal and cross-appeal, setting aside the case conference judge’s order in its entirety.

The court found that the case conference judge exceeded his authority under the Rules of Civil Procedure and failed to provide adequate reasons or an evidentiary record to support his decision regarding the existence and terms of a settlement.

The lack of intelligible reasons and evidentiary basis precluded meaningful appellate review.

The Court of Appeal for Ontario dismissed the appeal by Kurt Ashley Ritchie from an order upholding, with modification, a separation agreement between himself and Jessica Bortoleti De Oliveira.

The court found no error in the trial judge’s adjustment of child support or in the costs award, which reflected divided success and the parties’ conduct.

The court emphasized the ongoing obligation for both parties to exchange financial information annually and confirmed that no costs would be awarded for the appeal.

The Court of Appeal for Ontario dismissed the father’s appeal from a family law order that varied parenting and support arrangements.

The court found that the trial judge’s reasons were clear, sound, and based on the evidence, and that the findings were consistent with the Divorce Act.

The trial judge’s decision to grant the mother primary care and sole decision-making authority, as well as to vary child and spousal support, was upheld.

The court emphasized deference to the trial judge’s factual findings and the best interests of the children.

The Court of Appeal for Ontario dismissed motions to reconsider its earlier refusal to grant leave to appeal two decisions related to an arbitral award and its enforcement.

Dr. Bokhari argued that the panel may have been unaware that a key precedent (Aroma) was under reserve at the time of the refusal.

The court held that the relevant rules did not permit reconsideration based on subsequent jurisprudence, only on new facts, and that the interests of justice did not favour reconsideration.

The motions were dismissed.

The Ontario Court of Appeal dismissed David Jarvis’s appeal regarding his entitlement to exercise stock options after resigning as a director of 1CM Inc. The court found that the corporate documents clearly required Jarvis to be a director at the time of exercising the options.

Jarvis failed to demonstrate any error in the application judge’s interpretation of the plan.

The respondent was awarded costs of $15,000.

These two appeals arise from a receivership order under the Bankruptcy and Insolvency Act.

The motion judge found both the debtor and its management, as well as United Group of Companies and its management, in civil contempt of the receivership and asset recovery orders.

The Court of Appeal dismissed the appeals, finding no error in the motion judge’s reasoning or exercise of discretion, and confirmed the costs awards and sentences imposed.

The Court of Appeal for Ontario allowed Randy Hillier’s appeal, finding that Ontario’s absolute ban on outdoor peaceful assembly during the COVID-19 pandemic was not demonstrably justified under section 1 of the Charter.

The court held that the government failed to consider the impact of the gathering limits on the right to peaceful assembly under section 2(c) and did not tailor the restrictions to accommodate this fundamental freedom, unlike the approach taken for religious gatherings.

The decision clarifies the independent constitutional status of peaceful assembly and the necessity for governments to justify limits on this right, especially in the context of political protest.

The Ontario Court of Appeal dismissed the appeal by Neural Systems Inc., JiangJian Wang, and George Tarazi from a summary judgment granted in favour of the Business Development Bank of Canada.

The court found the appeal to be meritless and brought solely to delay judgment, noting that the debt remained unpaid and there was no genuine issue for trial.

The appellants' arguments regarding repayment efforts were rejected, and the appeal was dismissed with costs of $5,000 awarded to the respondent.

The Court of Appeal for Ontario dismissed Mason Perry’s appeal from a lifetime driving prohibition imposed as an ancillary order following his conviction for dangerous driving causing death and dangerous driving.

The court reviewed the facts, sentencing principles, and comparable cases, finding that the sentencing judge did not err in principle and that the prohibition was not demonstrably unfit.

The court emphasized the individualized nature of sentencing, the importance of public protection, and the relevance of mental health as a mitigating factor.

The decision confirms that lifetime driving prohibitions, though rare, may be appropriate in serious cases, especially where public safety is at risk.

Following a successful appeal that set aside the dismissal of their action under s. 137.1 of the Courts of Justice Act, the appellants sought costs of the motion below.

The respondents argued that the presumption against costs in s. 137.1(8) should apply.

The Court of Appeal agreed with the appellants that the presumption should not apply because the underlying dispute was a private matter and not a SLAPP.

The court awarded the appellants costs of the motion below fixed at $30,000.
