The majority held that although the reasonably foreseeable youthful-offender hypothetical warranted a fit sentence of five months’ incarceration, the additional month required by the mandatory minimum did not meet the demanding standard of gross disproportionality under s. 12 of the Charter.

The Court emphasized the grave and inherently exploitative nature of child sexual commodification, the priority of denunciation and deterrence in sentencing such offences, and the need to exclude irrelevant sympathetic details from hypothetical scenarios.

The declaration of invalidity issued by the Court of Appeal was therefore set aside.

The appeal concerned whether a defeated provincial election candidate could maintain a civil damages action against a chief electoral officer alleging bad-faith interference with his campaign.

The majority held that s. 16(2) of the Charter, interpreted purposively and in light of New Brunswick’s unique constitutional commitment to substantive linguistic equality, requires the holder of that unipersonal and highly symbolic office to be able to understand and communicate in both official languages when performing their functions.

The Court concluded that this requirement limits the exercise of the appointment power under s. 58 of the Constitution Act, 1867, but does not invalidate the office itself or amount to a constitutional amendment.

The delay was deducted, bringing the net delay under the ceiling, and the stay was set aside.

The accused was convicted of second degree murder after the victim was found beaten to death.

At trial, the judge relied on an out-of-court statement made by the victim during a phone call to establish the timeline of events and the accused's exclusive opportunity to commit the murder.

The Court of Appeal quashed the conviction and ordered a new trial, finding the trial judge impermissibly relied on the hearsay statement for the truth of its contents.

The Crown appealed from the Saskatchewan Court of Appeal's decision acquitting the respondent of refusing to comply with a breath demand.

Police had entered a private driveway to investigate an impaired driving complaint, found the accused asleep in a running truck, knocked on the window without response, then opened the truck door and detected a strong odour of alcohol.

The majority held that police had an implied licence to enter the driveway and knock on the truck window, but exceeded that licence by opening the door, constituting an unreasonable search under s. 8 of the Charter.

However, the evidence should not be excluded under s. 24(2) given society's strong interest in prosecuting the serious offence.

Four justices dissented, finding that the police exceeded the implied licence from the moment they entered the property with the intent to gather evidence, and that the evidence should be excluded.

The appellant challenged the constitutionality of s. 3 of Quebec's Reduced Contribution Regulation, which excluded refugee claimants from eligibility for subsidized childcare.
