The Court of Appeal dismissed the appeal, finding no procedural unfairness as the issues were squarely before the lower court, upholding the summary determination as agreed by parties, confirming the unjust enrichment claim was not properly advanced, and reiterating that settlements, while generally final, can be rescinded on valid contractual grounds.
Leave to appeal costs was also denied.
