Summary conviction appeal arising from a road rage incident involving convictions for dangerous operation of a motor vehicle and assault with intent to resist arrest.

The appellant argued the trial judge erred in the findings of guilt and in refusing to stay the charges after finding a s. 7 Charter breach based on excessive force by an off-duty police officer.

The trial judge admitted the videotaped statement as hearsay evidence based on necessity and reliability, but rejected the application to introduce evidence of prior conduct, finding insufficient probative value.

The applicant sought Charter relief arising from a brief roadside stop during a police search for escaped youths.

The court held the officers had articulable cause to stop the truck to determine whether its occupants were the missing youths, and that the detention was justified under the common law investigative detention power.

After the officers observed the driver switch seats with a rear passenger, the court found there were fresh grounds for a regulatory detention and licence inquiry under the Highway Traffic Act.

Although the Crown conceded a s. 10(b) breach and abandoned reliance on the applicant's admission, the application was dismissed.

On a summary conviction appeal from convictions for assault with a weapon and assault causing bodily harm arising from a nightclub altercation, the appellant challenged both the adequacy of the trial reasons and the reasonableness of the verdict.

The court held that the trial judge failed to explain how exculpatory eyewitness evidence was treated, failed to explain how equivocal recognition evidence from grainy surveillance video established identity, and referred to legal doctrines that had no clear application to the evidentiary record.

After independently reviewing the surveillance footage and the totality of the evidence, the court concluded that no properly instructed trier could reasonably find identity proven beyond a reasonable doubt.

The appeal was allowed, the convictions were set aside, and acquittals were entered.

Summary conviction appeal from convictions for impaired driving and refusing to provide a breath sample arising from erratic operation of a tractor trailer followed by a civilian witness into a truck stop.

The appellant argued the trial judge improperly inferred identity and care and control from circumstantial evidence, relying on alternative explanations such as a passenger or attendant.

The appeal court held that alternative theories not grounded in evidence were speculative, and that the totality of the evidence supported the finding that the appellant was the driver.

The court also held that the police had reasonable and probable grounds for the breath demand even apart from proof beyond a reasonable doubt of identity.

The defendant brought a Charter s. 11(b) application alleging that his right to trial within a reasonable time had been infringed.

The defendant was charged with refusing to comply with a demand to provide a breath sample under s. 254(2) of the Criminal Code.

The total delay from arrest to trial was approximately 13 months.

The court found that while a reasonable intake period of 6 weeks was appropriate, the Crown's delay in providing disclosure was unjustified, taking over three months to provide 14 pages of police notes.

The court also found that the defendant suffered actual prejudice in the form of emotional and physical symptoms, including depression, anxiety, and stress-related health issues.

Balancing the factors under the Morin test, the court found the delay unreasonable and granted a stay of proceedings.

The appellant appealed his conviction for driving with a blood alcohol level over .80, arguing that the intoxilyzer was not proven to be functioning properly because the technician used an external printer and did not check the internal printer.

The Summary Conviction Appeal Court upheld the trial judge's finding that the intoxilyzer was in proper working order.

The accused denied all charges, asserting that his physical contact with students was necessary and incidental to teaching figure skating skills, and that his comments were made in appropriate coaching contexts.

The trial involved six days of evidence and focused heavily on credibility assessments of the complainants, their parents, and the accused.

The Crown appealed a summary conviction acquittal for operating a motor vehicle with blood alcohol exceeding 80 mg under the Criminal Code.

The trial judge had excluded the breathalyzer evidence after finding the Crown failed to prove the samples were taken “as soon as practicable” under s. 258(1)(c)(ii), because police facilitated a 30‑minute telephone call between the accused and his mother before testing.

On appeal, the Crown argued the trial judge applied the wrong legal standard and effectively required testing “as soon as possible.” The Superior Court held the trial judge applied the correct legal test and that the determination regarding the reasonableness of the delay was a factual finding entitled to deference.

As there was evidence supporting the finding that the delay rendered the samples not taken as soon as practicable, no palpable and overriding error was established.

The appellant appealed his conviction for driving with excess blood alcohol, arguing the trial judge erred in dismissing his Charter application to exclude breath sample evidence.

The appellant contended the trial judge gave insufficient reasons, misapprehended evidence regarding the officers' reasonable grounds for the breath demand, and erred in the section 24(2) analysis.

The Summary Conviction Appeal Court found no error in the trial judge's conclusion that the officers had reasonable grounds based on the appellant's driving, odour of alcohol, and unsteadiness.

The appeal was dismissed.

The appellant appealed a conviction for impaired operation, arguing the trial judge erred in dismissing a s. 11(b) Charter application alleging delay in bringing the matter to trial.

The case involved approximately 23 months from the swearing of the information to conviction, including adjournments related to the absence of a police officer whom the defence wished to call as a witness on a Charter application.

The court held that the officer was a defence witness and that his absence did not constitute Crown delay, and most of the disputed periods were either neutral delay or defence-related.

Although the trial judge erred in suggesting prejudice need not be examined where institutional delay fell below guideline thresholds, the appellate court found that any prejudice was limited and insufficient to render the delay unreasonable.

The conviction and dismissal of the Charter application were upheld.

Alternatively, the court held that even if the amendment was premature, no prejudice or miscarriage of justice resulted because the amendment merely corrected the wording to reflect the proper roadside demand offence.

The curative proviso under the Criminal Code therefore applied and the convictions were upheld.

The appellant appealed a conviction for dangerous driving following a trial in the Ontario Court of Justice.

The sole ground of appeal argued that the trial judge improperly applied the rule in Browne v. Dunn by diminishing the weight of the defence evidence because the defence version was not put to Crown witnesses during cross-examination.

The appellate court held that trial judges retain discretion in determining how to address a breach of the rule, including considering the failure to cross-examine when assessing credibility.

The court found that defence counsel had the opportunity to seek recall of witnesses after the issue was raised but chose not to do so.

The trial judge’s treatment of the issue was a permissible exercise of discretion and did not amount to reversible error.

The appellant appealed a summary conviction for operating a motor vehicle with blood alcohol exceeding the legal limit, arguing that the trial judge unreasonably concluded he was in care or control of the vehicle.

The appellant had been seated in the driver’s seat of a running vehicle with the headlights and heater on while intoxicated, claiming he intended to walk to a friend’s house rather than drive.

Applying the principles from R. v. Boudreault, the court held that the trial judge reasonably found a realistic risk of danger because the appellant’s alleged alternate plan was vague and had been undermined by subsequent events.

The trial judge was entitled to conclude the appellant exercised care or control by unlocking, starting, and occupying the vehicle without a concrete plan.

The verdict was supported by the evidence and not unreasonable.
