The Court of Appeal dismissed the Crown's appeal, holding that the G1 licence restrictions were irrelevant to the modified objective test for dangerous driving unless they indicated an incapacity to appreciate or avoid the specific risk involved.

A senior police officer with the Halton Regional Police Service pleaded guilty to breach of trust under section 122 of the Criminal Code for stealing oxycodone pills from a police evidence locker between August 27, 2015 and April 30, 2016.

The officer had developed an addiction to prescription opioids following multiple knee surgeries and work-related injuries, compounded by untreated PTSD and workplace harassment.

The court imposed a conditional discharge with three years probation, 240 hours of community service, and a victim fine surcharge, finding that exceptional circumstances—including the officer's addiction, mental health issues, early guilty plea, comprehensive rehabilitation efforts, and strong family and community support—justified a discharge despite the serious nature of the breach of trust offense.

Three appellants convicted of first and second degree murder appealed their convictions.

The offender, an on-duty police officer, was convicted of dangerous driving causing bodily harm after colliding with another vehicle while responding to an emergency call at 178 km/h in a 50 km/h zone.

The defence sought an absolute discharge, arguing the officer's motive mitigated his moral culpability.

The court found that while a discharge was in the offender's best interests, it was contrary to the public interest due to the need for general deterrence and denunciation.

A conviction was registered, and the offender was sentenced to a $2,500 fine and a 12-month driving prohibition.

Postmedia Network Inc. applied to lift a sealing order on an Information to Obtain (ITO) related to a police investigation into Elizabeth Wettlaufer, who faced multiple murder and assault charges.

The Crown and counsel for the accused opposed the application.

The court applied the Dagenais-Mentuk test, finding that much of the redacted "Incriminating information" in the ITO posed a serious risk to the accused's fair trial rights, which could not be mitigated by alternative measures due to the national media attention and highly prejudicial nature of the information (e.g., confessions, DNA evidence).

While acknowledging the impact on freedom of the press, the court determined that the temporary sealing, with a further redacted version immediately accessible and a complete un-redacted version to be released after trial, balanced these rights.

The application to lift the sealing order was dismissed, but the existing order was varied to un-redact certain passages as detailed in Schedule A.

The appellant appealed convictions for touching a person under the age of 16 years for a sexual purpose and sexual assault.

He collided with a civilian vehicle making a left turn, causing bodily harm to the civilian driver.

The court found that while the civilian driver failed to pull over, the accused's excessive speed in a residential area with multiple hazards was a marked departure from the standard of care expected of a reasonable police officer in the circumstances.

The accused was charged with sexually assaulting a complainant in his home after they met at a bar and shared a taxi.

The complainant testified that she was pinned down and forcibly penetrated while repeatedly telling the accused to stop.

The accused testified that all sexual contact was consensual.

The trial judge found the accused's testimony to be deliberately misleading on material points regarding his interest in the complainant and the circumstances of leaving the bar.

However, the judge also found the complainant's testimony to be unreliable due to significant memory loss inconsistent with her alcohol consumption and numerous prior statements to others describing consensual sexual activity that turned rough.

The judge concluded that while the accused's guilt was possible or even probable, a reasonable doubt existed regarding whether the complainant withdrew consent, and therefore acquitted the accused.

Robert Hansen, a Detective Constable with the Hamilton Police Service, was convicted of perjury and two counts of attempt to obstruct justice for knowingly making false statements in an Information to Obtain a Search Warrant and encouraging an informant to plant a firearm.

The court considered aggravating factors, including breach of trust, planned and deliberate actions, and the intention to implicate an innocent person, and mitigating factors such as no prior record, loss of employment, and difficult protective custody.

The Crown sought a six-year sentence, while the defence sought sixteen months.

The court imposed a six-month custodial sentence followed by two years of probation, finding that incarceration was necessary to reflect denunciation and general deterrence given the accused's position of trust as a lawyer and the serious breach of professional integrity.

A police officer with 14 years of service pleaded guilty to breach of trust and careless storage of a firearm.

The Crown sought 12 months imprisonment plus probation, emphasizing denunciation and deterrence.

The court found exceptional mitigating circumstances including severe alcohol addiction, emotional abuse by a partner, unresolved grief from a parent's death, and a sleep disorder.

The officer had undergone significant rehabilitation post-arrest, including residential treatment, weekly AA attendance, and psychotherapy.

Despite the serious nature of breaching a position of trust, the court imposed a suspended sentence with three years probation and 150 hours community service, recognizing that the officer's conduct was entirely out of character and driven by addiction rather than corruption or venality.
