The Court of Appeal found the trial judge erred in law by requiring proof of the specific timeframe, as this was not an essential element of the offence.

The appellant appealed his conviction for aggravated assault and his sentence.

The trial judge found that while the appellant initially acted in self-defence during an altercation with an intruder in his apartment, he went beyond the limits of self-defence by continuing to strike the victim with a metal object after the threat had diminished.

The conviction appeal was dismissed as the trial judge's findings were supported by the evidence.

However, the sentence appeal was allowed.

The appellate court found the trial judge erred in principle by failing to recognize the significant mitigating factors arising from the appellant's initial justification in self-defence and the victim's role as an aggressor and trespasser.

The complainant, the appellant's 16-year-old daughter, testified that while intoxicated and in her bedroom, she was sexually assaulted by the appellant.

The appellant appealed on four grounds: that the trial judge applied different standards of scrutiny to the evidence, failed to properly apply the W(D) principles, failed to critically analyze the Facebook message evidence, and failed to consider the absence of medical or forensic evidence.

The Court of Appeal dismissed all grounds of appeal, finding that the trial judge properly analyzed the evidence, applied the correct legal principles, and that the complainant's testimony was sufficient to ground the conviction.

The appellant challenged an order permitting an FBI "clean team" to examine seized computer servers and prepare a report to assist the court in determining what material should be sent to the United States under the Mutual Legal Assistance in Criminal Matters Act.

The servers were seized pursuant to a valid search warrant in connection with an investigation into alleged copyright infringement.

The court held that while the application judge had jurisdiction under section 15(2) of the Act to make such an order, the application judge erred in failing to consider the effect on the appearance of fairness and judicial impartiality of having an entity closely associated with one of the adversaries examine the material and prepare the report.

The court set aside the order and held that any entity retained to assist the judge should be independent of the interested parties, absent compelling circumstances such as unique expertise.

The appellant appealed his committal for extradition to the United States and sought judicial review of the Minister of Justice's surrender order.

The appellant challenged the reliability of co-conspirator evidence and argued that extradition would violate his Charter rights under sections 6(1) and 7.

The Court of Appeal upheld the committal and dismissed the judicial review application, finding that the reliability of witness evidence is a matter for the receiving jurisdiction, that the possible sentence would not shock the conscience, and that the Minister's decision to defer to US proceedings was reasonable and justified under the Cotroni factors.

The applicant, Marco Viscomi, brought a Charter application to exclude Canadian-gathered evidence from a second extradition application, alleging unlawful residential searches, improper execution of searches, unauthorized forensic searches, unlawful detention of seized items, and a breach of the affiant's duty of candour in obtaining a search warrant.

The court dismissed the application, finding that the search warrants were lawfully issued, the forensic searches were authorized, the detention of items was not contrary to the Charter, and there was no material breach of the duty of candour.

While acknowledging potential minor Charter breaches related to arbitrary detention, the court concluded that these were not serious and had no meaningful impact on the lawfulness of the evidence seizure, thus not warranting exclusion under s. 24(2) of the Charter.

The Attorney General of Canada, on behalf of the United States, sought an order for the committal for extradition of Jhoan Manuel Ciprian-Guzman for the Canadian offence of possession of child pornography.

Guzman opposed the application and brought a cross-application for a stay of proceedings, arguing that the anticipated prison conditions in Florida would violate his Charter rights.

The court found that the test for committal was met and dismissed Guzman's cross-application, holding that the extradition judge's jurisdiction to consider Charter issues is limited to the fairness and integrity of the committal hearing itself, not the potential future treatment or punishment in the requesting state, which falls under the Minister of Justice's purview.
