The appellant, a pub co-owner, appealed his summary conviction for assault causing bodily harm after pushing a patron off a barstool.

The accused had been found seated in the driver’s seat of a running vehicle in a pub parking lot with breath readings of 110 and 100 mg/100 ml.

The trial judge concluded there was no realistic risk of danger and that the accused had rebutted the statutory presumption of care or control based on an alleged alternate plan to obtain a ride.

The appeal court held that the trial judge misapplied the test from R. v. Boudreault by focusing on visible impairment rather than the legal significance of an over‑80 reading and by treating a vague or unimplemented plan as sufficient to rebut the presumption.

The acquittal was set aside and a conviction substituted.

The appellant appealed a conviction for operating a motor vehicle with blood alcohol exceeding 80 mg contrary to the Criminal Code.

He argued that the breath samples were not taken "as soon as practicable" under s. 258(1)(c)(ii) due to a 90‑minute delay between the roadside stop and the first Intoxilyzer test, and that his s. 10(b) Charter right to counsel was breached by a delay before speaking with Legal Aid.

The court held that the trial judge’s findings of fact regarding police resource allocation and transport to a detachment with a breath technician were reasonable and entitled to deference.

The evidence supported the conclusion that the breath tests were taken as soon as practicable and that the right to counsel was not violated.

Even if a breach had occurred, the breath results would not have been excluded under s. 24(2).

The appellant appealed her summary conviction for driving 'over 80', alleging ineffective assistance of trial counsel.

She argued that trial counsel failed to request maintenance and calibration records for the approved instrument and that his failings caused adjudicative unfairness.

The Superior Court of Justice dismissed the appeal, finding that trial counsel provided reasonable professional assistance by retaining an expert, considering defences, and holding the Crown to its burden of proof, and that no miscarriage of justice occurred.

The appellant appealed a summary conviction for failing to provide a breath sample, arguing ineffective assistance of trial counsel.

The court held the appellant sufficiently understood and participated in the proceedings and neither he nor counsel requested an interpreter.

The trial judge’s questioning did not create an appearance of unfairness.

Applying the test from Boudreault, the court found the trial judge reasonably concluded there was a realistic risk the impaired appellant could put the vehicle in motion.

The appellant appealed a conviction for failing to comply with a bail condition requiring him to remain at his residence except for limited specified purposes.

He argued the trial judge shifted the burden of proof contrary to the principles in R. v. W.(D.), improperly relied on his failure to provide a detailed explanation to police, misapprehended the evidence, and improperly took judicial notice regarding evening traffic conditions.

The court held that the trial judge properly applied the presumption of innocence and the W.(D.) framework, permissibly assessed the credibility of competing testimony, and did not infringe the appellant’s right to silence.

The court also found no material misapprehension of evidence and concluded that the limited judicial notice regarding reduced evening traffic congestion was permissible.

The conviction was upheld.

The appellant appealed his summary convictions for committing an indecent act and dangerous driving.

The trial judge had convicted the appellant of the indecent act based on a perceived legal presumption that intent to act wilfully arises when the act is seen by another person.

The appeal court found this to be a legal error, as no such presumption exists, and ordered a new trial on the indecent act charge.

The appeal against the dangerous driving conviction was dismissed, as the trial judge reasonably concluded the appellant's driving in heavy fog was a marked departure from the standard of care.

The appellant appealed summary conviction findings of guilt for two counts of assault and one count of uttering threats.

He argued that the trial judge improperly rejected his evidence, accepted the complainants’ evidence despite inconsistencies, and provided insufficient reasons for the credibility findings.

The court held that while credibility findings normally attract deference, the trial judge’s reasons did not address significant inconsistencies in the evidence and failed to explain the path to conviction.

Applying the functional test for adequacy of reasons from appellate jurisprudence, the court concluded the reasons were insufficient to permit meaningful appellate review.

This constituted an error of law requiring intervention.

The appellant appealed convictions for refusal to provide a breath sample, impaired driving, and mischief under $5,000 arising from a single‑vehicle accident and subsequent conduct in a police cruiser and breath room.

The court reviewed the trial judge’s findings regarding whether the appellant intentionally refused a breath demand and whether her emotional state constituted a reasonable excuse.

The appellant appealed a summary conviction for impaired driving (care and control) arising from being found asleep in a parked vehicle with the engine running.

The appellant argued the trial judge failed to find that the evidence raised a reasonable doubt regarding impairment and failed to adequately explain the rejection of the defence evidence that the behaviour observed by police was caused by fatigue rather than alcohol consumption.

The court held that the trial judge’s credibility findings and factual determinations were supported by the evidence and entitled to significant appellate deference.

The reasons, read as a whole, sufficiently explained the rejection of the defence theory and the application of the W.D. framework.

No error of law, misapprehension of evidence, or miscarriage of justice was established.

The Crown appealed a summary conviction acquittal on a charge of dangerous driving arising from a high-speed police stop on the Don Valley Parkway.

The trial judge had found that audio and video recordings from a police in-car camera contradicted key aspects of the arresting officer’s testimony regarding aggressive driving and road conditions, leading to concerns about the reliability of the officers’ evidence.

The trial judge concluded that the evidence did not establish a marked departure from the standard of care required for dangerous driving and that the Crown had not proven the offence beyond a reasonable doubt.

On appeal, the Crown argued that the trial judge misapprehended the evidence by comparing testimony with recordings that did not capture the entire driving sequence.

The appeal court held that the trial judge understood the limited scope of the recording and committed no palpable and overriding error in assessing credibility and reliability.

Deference to the trial judge’s factual findings required dismissal of the appeal.

The appellant appealed a summary conviction for dangerous driving, arguing that the trial judge misapprehended the evidence and failed to properly consider evidence suggesting the driving was the result of a momentary lapse.

The appellant also argued the trial judge relied on extrinsic information relating to possible alcohol impairment despite the withdrawal of the excess blood alcohol charge.

The court reviewed the applicable standards of review for factual and legal errors and considered whether the trial judge failed to address potentially exculpatory evidence.

The court held that the trial judge properly considered the evidence, rejected the momentary lapse explanation, and did not rely on extrinsic information.

The conviction was upheld.

The Crown appealed the accused's acquittal on an 'Over 80' charge.

The trial judge had excluded the breath test results under s. 24(2) of the Charter, finding a s. 8 breach because the arresting officer failed to turn his mind to the issue of mouth alcohol before administering an Approved Screening Device (ASD) test.

The Superior Court of Justice allowed the appeal, holding that the trial judge erred in concluding the officer's grounds could not be assessed objectively, materially misapprehended the evidence by interrupting the Crown's re-examination, and erred in her s. 24(2) Grant analysis by drawing unwarranted inferences about police training.

A new trial was ordered.

The appellant appealed his summary conviction for impaired operation of a motor vehicle.

He argued the trial judge misapprehended evidence regarding his language barriers, physical limitations, and alternative explanations for his erratic driving.

The Summary Conviction Appeal Court found no misapprehension of evidence, holding that the trial judge properly assessed the totality of the evidence, including police and civilian witness testimony, and that the findings of fact were reasonably supported.

The appeal was dismissed.

The Crown appealed acquittals on impaired operation and over-80 charges arising from a roadside stop involving swerving, indicia of alcohol consumption, and later breath readings of 140 mg.

The appeal court held that the trial judge reasonably found the respondent had clearly waived the right to counsel, and that the police-created delay in arranging an unnecessary duty counsel call meant the breath samples were not taken as soon as practicable under s. 258(1)(c)(ii) of the Criminal Code.

The certificate evidence was therefore properly excluded.

On the impaired operation count, the court held the acquittal was reasonably supported by the evidence, given the limited bad driving and minimal indicia of impairment.

On a summary conviction appeal from a conviction for failing to comply with a recognizance, the appellant argued the Crown had not proven he was absent from his residence other than under permitted work or school exceptions.

The court held there was evidence supporting the findings that the recognizance was in force and that the appellant was not at home during the compliance check.

However, because the Information expressly pleaded the exceptions, and the police had no knowledge of the appellant’s work or school arrangements and conducted no investigation into them, the Crown failed to negative those exceptions even on a prima facie basis.

The appeal was allowed and a new trial was ordered before a different judge.

Summary conviction appeal from convictions arising out of an impaired care and control investigation where the appellant was found asleep in the driver's seat of a vehicle stopped in a live lane with the engine on and gear in drive.

The appellant argued the breath samples were not taken as soon as practicable, the officer lacked reasonable and probable grounds for the breath demand, and the evidence did not prove impairment beyond a reasonable doubt.

The appeal court held that the police acted reasonably in waiting in the sally-port and in contacting duty counsel given the appellant's state of intoxication, and that the officer had sufficient grounds based on the totality of observations.

The court further held that the trial judge's conclusion on impaired care and control was open on the evidence and the appeal was dismissed.

The appellant appealed a summary conviction for excess blood alcohol, arguing that the trial judge erred in upholding the arresting officer’s grounds, rejecting a right-to-counsel breach, and finding the breath tests were taken as soon as practicable.

The court held that the officer had reasonable and probable grounds based on the driving conduct and multiple indicia of impairment, notwithstanding some inconsistencies with later video evidence.

The court further held that the appellant was afforded a reasonable opportunity to consult duty counsel in private and adduced no evidence that the video presence impaired that consultation.

Finally, the court found the breath samples, taken within 65 and 88 minutes of driving, were obtained as soon as practicable in the circumstances.

The appeal was dismissed and the stay of the driving prohibition was vacated.
