Sentencing of a declared dangerous offender serving a ten-year long-term supervision order for two counts of failing to comply with LTSO conditions, namely cocaine consumption and failure to provide documented financial information.

The court assessed the offender's extensive criminal record of violent robberies, his intractable substance abuse directly linked to violent recidivism, the intergenerational trauma stemming from the residential school and child welfare systems, and his inconsistent rehabilitative engagement, concluding that public protection must predominate as an enhanced sentencing objective notwithstanding applicable Gladue factors.

Sentencing for making child pornography available and possession of child pornography contrary to ss. 161.1(3) and 161.1(4) of the Criminal Code.

The offender uploaded 59 files depicting sexual exploitation of children to a chat platform to attract potential sexual partners.

Despite significant mitigating factors including guilty pleas, no prior record, genuine remorse, low recidivism risk, and strong rehabilitation prospects, the court declined a conditional sentence, holding that the gravity of the offences and the imperative of denunciation and deterrence precluded community-based disposition.

The court imposed 18 months imprisonment concurrent on both counts.

Sentencing for impaired operation of a motor vehicle causing bodily harm contrary to s. 320.14(2) of the Criminal Code.

The offender, with a BAC of 180 mg/100 mL, lost control of his vehicle carrying four passengers, striking a concrete light post and overturning.

The front-seat passenger sustained life-threatening injuries including permanent hearing loss and facial nerve damage.

Despite the Crown seeking six to nine months' incarceration, the court determined 12 months was the appropriate custodial range but imposed a 15-month conditional sentence served in the community with strict house arrest, electronic monitoring, and alcohol abstinence conditions, followed by 18 months' probation and an 18-month driving prohibition.

Sentencing for summary conviction assault of offender's minor daughter in the family home, involving multiple applications of force causing visible injuries, committed to prevent the child from intervening in a spousal dispute.

Court rejected defence request for conditional discharge, finding it contrary to the public interest given the seriousness of the assault, statutory aggravating factors including breach of trust and victim under 18, significant victim impact, and absence of remorse or acceptance of responsibility.

Court also declined conditional sentence as inconsistent with the fundamental purpose and principles of sentencing.

Intermittent jail sentence of 30 days imposed followed by 12 months probation, with DNA order.

Accused charged with causing a disturbance and assaulting a peace officer sought a stay of proceedings pursuant to s. 11(b) of the Charter on the basis that her right to be tried within a reasonable time had been breached.

The overall delay was 718 days.

After deducting 99 days of defence-caused delay attributable to failure to retain counsel, obtaining instructions, counsel unavailability for judicial pre-trial, and a partial attribution of unavailability for continuation dates, the net delay was 619 days, exceeding the 18-month presumptive ceiling by 71 days.

The Crown failed to establish exceptional circumstances, as the case was routine and straightforward, lacking the hallmarks of complexity, and the Crown had not developed a concrete plan to minimize delay occasioned by any alleged administrative complexity.

Criminal trial on multiple counts of assault, assault causing bodily harm, and failing to comply with probation orders arising from three alleged incidents of intimate partner violence in 2023.

The Crown invited dismissal of charges relating to the third incident.

The court assessed the complainant's credibility and reliability, finding that her combative demeanour under cross-examination was attributable to the prolonged proceedings, the manner of cross-examination, and her personal circumstances as a young Indigenous woman, rather than reflecting on her truthfulness.

The court found the complainant's core evidence on the remaining two incidents was compelling, internally consistent, and corroborated by CCTV footage, medical records, body-worn camera evidence, and photographic documentation of injuries.

Crown appeal of a Justice of the Peace's decision granting a stay under s. 11(b) of the Charter for unreasonable delay in a provincial offences careless driving prosecution.

The central issue was whether the 11(b) clock commenced upon filing the certificate of offence or upon the defendant's election to proceed to trial after an early resolution meeting.

The court held the Justice of the Peace erred in calculating total delay from the date of filing; the period from charge to early resolution constitutes implicit defence waiver, as the defendant was pursuing resolution rather than trial.

Deducting that period reduced net delay to approximately 7 months, well below the 18-month Jordan ceiling.

The accused pleaded guilty to dangerous driving and assaulting a police sergeant with intent to resist arrest.

The Crown proceeded summarily and sought 90 days imprisonment served intermittently, while defence counsel sought a conditional discharge.

The court rejected the conditional discharge as inappropriate and contrary to the public interest, finding that the accused's conduct—fleeing from police at speeds exceeding 120 km/h and resisting arrest—posed serious risks to public safety.

Instead, the court imposed a conditional sentence of 90 days to be served in the community, followed by two years probation, with strict conditions including house arrest, a driving prohibition, community service, and a DNA order.

The defendant was charged with operating a motor vehicle with more than 80 milligrams of alcohol in 100 millilitres of blood.

The defence brought a Charter application seeking to exclude statements made by the defendant to the investigating officer at the roadside, arguing they were compelled under the statutory accident reporting provisions of the Highway Traffic Act and therefore violated the right against self-incrimination under section 7 of the Charter.

The Crown argued the defendant was not compelled to make statements and was properly cautioned.

The court held that the defendant's statements were not made pursuant to statutory compulsion and therefore were admissible.

The application was dismissed.

The accused pleaded guilty to impaired driving causing death contrary to section 255(3) of the Criminal Code.

The collision occurred on March 10, 2013, when the accused, driving eastbound on Innes Road with a blood alcohol concentration between 165-230 mg/100mL, failed to stop at a stop sign and collided with the victim's vehicle at high speed.

The victim died at the scene from multiple trauma.

The accused was subsequently arrested for breaching bail conditions by consuming alcohol and tampering with an alcohol-monitoring bracelet.

The court imposed a sentence of four years and nine months with a 12-year driving prohibition, balancing denunciation and general deterrence against rehabilitation and the accused's youth and lack of prior criminal record.

The accused were charged with possession of cocaine and cannabis marijuana, possession of a prohibited weapon, and firearm-related offences arising from items seized during the execution of search warrants.

The accused challenged the validity of the search warrants under section 8 of the Charter and the accused Olsson also challenged her arrest under section 9 of the Charter.

The court found that the Information to Obtain contained sufficient credible and reliable evidence to support the issuance of the warrants, establishing both spatial and temporal nexus between the items sought and the place to be searched.

The court also found that the arresting officer had reasonable and probable grounds to arrest Olsson.

Both Charter applications were dismissed.

The accused was charged with operation of a motor vehicle while impaired by alcohol.

He was found passed out in the driver's seat of a parked vehicle with the key in the ignition.

The accused conceded impairment but argued he was not in care or control of the vehicle because he had arranged for a friend to pick him up.

The court found that while the accused may have initially intended not to drive, his high level of intoxication, confused state, weak explanations for his conduct, and demonstrated willingness to manipulate the gear shift when police arrived established a realistic risk he would change his mind and operate the vehicle.

The court convicted the accused.

The Crown applied to admit a videotaped statement made by the complainant, Ms. Jacqueline Lawton, to Peel Regional Police on August 5, 2012, pursuant to the rule of past recollection recorded.

The witness testified that she had blurred and groggy memories of the events due to consuming vodka and medication, but recalled certain details such as the windshield being smashed and her subsequent actions.

The court found that the witness did not have a genuine loss of memory but rather a selective memory, deliberately choosing not to recall certain events.

The application was dismissed.

The defendant was charged with sexual assault and unlawfully in a dwelling.

The Crown proceeded by summary conviction.

The defendant pleaded not guilty and raised the defence of non-insane automatism in the form of parasomnia (sexomnia), claiming he was asleep during the alleged assault.

The trial judge rejected the automatism defence, finding the defendant had not established a proper evidentiary foundation on a balance of probabilities.

The judge found the defendant's account of events was inconsistent and unreliable, and that his actions demonstrated conscious, purposeful decision-making inconsistent with parasomnia.

The defendant was found guilty of sexual assault but acquitted of the unlawfully in a dwelling charge due to reasonable doubt regarding specific intent.

The defendant was charged with failing to stop at a stop sign contrary to section 136(1)(a) of the Highway Traffic Act.

The prosecution presented evidence from a police officer who observed the defendant's vehicle pass through a stop sign at approximately 5-7 km/h without coming to a complete stop.

The defendant testified that he stopped his vehicle behind the marked stop line before proceeding through the intersection.

The court found that while the offence is one of absolute liability requiring only proof of the actus reus, the prosecution failed to establish guilt beyond a reasonable doubt due to significant uncertainty regarding the officer's vantage point (possibly 50 metres or more from the intersection rather than the stated 10 metres) and the credible, consistent testimony of the defendant.

The defendant was acquitted.

The accused brought a renewed motion for disclosure of Ottawa Police occurrence reports relating to prior police contacts within 90 days prior to the alleged offence.

The Crown initially opposed disclosure under the Mills regime for third party records in sexual offence prosecutions.

Following the Ontario Court of Appeal's decision in R. v. Quesnelle, which held that police occurrence reports prepared by the investigating police force are not "records" under section 278.1 and are therefore governed by the Stinchcombe disclosure regime rather than the Mills regime, the court reconsidered its initial ruling.

The court found that Quesnelle could be reconciled with prior authority from R. v. McNeil and R. v. Thompson and determined that the Crown must apply the Stinchcombe disclosure obligation to produce occurrence reports relating to the complainant that are in the possession of the investigating police force.

The accused pleaded guilty to possessing a genuine Nigerian passport that could be used to establish identity contrary to section 122(1)(a) of the Immigration and Refugee Protection Act, and to misrepresenting or withholding material facts relating to the true identity of a passenger that could induce an error in the administration of the Act contrary to section 127(a).

The Crown sought a custodial sentence of approximately nine months, while defence counsel sought a conditional sentence.

The court imposed a conditional sentence of one year to be served in the community with strict conditions, including house arrest for the first six months, community service, and ongoing supervision.

The accused was charged with impaired operation of a motor vehicle and exceeding the legal limit contrary to the Criminal Code.

The defence brought a section 24(2) Charter application seeking exclusion of breath test evidence based on an alleged violation of section 10(b) rights (right to counsel).

The accused gave an equivocal response ("at this point no") when initially asked if he wished to call a lawyer.

The court found that although the initial response was equivocal, the breath technician subsequently clarified the accused's wishes and the accused unequivocally declined counsel.

The court rejected the accused's credibility regarding his understanding of the situation and his claim that he wanted to speak to a lawyer.

The Charter application was dismissed.

The accused was charged with dangerous driving, impaired driving, and driving with excess alcohol following a traffic stop on Highway 400.

The Crown's case established that the accused was speeding and changing lanes erratically.

After a roadside screening device failure, breath samples were obtained showing readings of 210 and 200 milligrams of alcohol per 100 millilitres of blood.

The court found the accused not guilty of impaired driving due to insufficient evidence of impairment beyond the blood alcohol readings.

The court upheld the validity of the breath tests as taken as soon as practicable and found no Charter breach.

The accused was convicted of driving with excess alcohol under section 253(1)(b) of the Criminal Code.

The accused was charged with impaired driving and over 80 offences.

He brought two Charter applications: one alleging arbitrary arrest and withheld fundamental disclosure (sections 7, 8, and 9), and another alleging unreasonable delay (section 11(b)).

The court dismissed both applications.

The disclosure application was partially dismissed at the pre-trial stage, with the court finding the Crown had met its threshold disclosure obligations.

The delay application was dismissed after the court calculated that only approximately eight months of the 27-month period constituted cognizable delay under section 11(b), with the remainder attributable to inherent time requirements and defence conduct.

The court found that while the accused suffered actual and inferred prejudice, the societal interest in a trial on the merits outweighed such prejudice.
