Hayden Bieber pleaded guilty to impaired operation of a conveyance, possession of property obtained by crime, possession of a weapon dangerous to public peace (all Criminal Code offences), and possession of fentanyl for the purpose of trafficking (Controlled Drugs and Substances Act).
The offences occurred following a traffic stop where police found drugs, cash, and brass knuckles.
Bieber, 25, had no prior criminal record and had made significant efforts towards rehabilitation, including abstaining from drugs for a year and attending Narcotics Anonymous.
The Crown sought a 4-year incarceration, while the defence requested a conditional sentence of two years less a day, or a sentence in the upper reformatory/lower penitentiary range if incarceration was necessary.
The court emphasized denunciation and general deterrence for fentanyl trafficking, finding that a conditional sentence was inappropriate despite Bieber's rehabilitative efforts and lack of criminal record.
The judge imposed a global sentence of 36 months (3 years) of imprisonment, after applying credit for pre-sentence release conditions and the impact of the COVID-19 pandemic on incarceration.
Ancillary orders included a DNA sample, a 10-year weapons prohibition, and forfeiture/destruction of seized substances.
