Justin Taillefer was charged with eleven counts of possession for the purpose of trafficking under the Controlled Drugs and Substances Act and four firearm-related offences.

Police executed a search warrant at his apartment on January 26, 2023, and discovered approximately $3.2 million in drugs in a second bedroom, along with various other controlled substances throughout the apartment and a loaded handgun.

The accused admitted to possessing some drugs found in common areas but denied knowledge of the large quantity of drugs in the second bedroom or the firearm.

The trial judge found the accused guilty of eleven drug trafficking counts but acquitted him on all firearm charges.

The conviction was based on constructive possession, finding that the accused either had actual knowledge or was willfully blind to his roommate's drug trafficking operation in the second bedroom.

The defendant, Matthew Legault, was charged with aggravated assault on Christopher Chrisjohn at Elgin-Middlesex Detention Centre.

Legault admitted to two physical altercations but claimed consent.

The Crown argued Legault was liable as a principal and as a party to a group assault.

The court found Legault's testimony incredible and unbelievable due to numerous inconsistencies.

While the Crown could not prove beyond a reasonable doubt that Legault as principal caused the "wounding" injuries (nasal bone fractures, gash between eyes) due to a subsequent attack by another inmate, it found him liable as principal for the lesser included offence of assault causing bodily harm.

Ultimately, the court found Legault liable as an aider and abettor for the aggravated assault, concluding that the 34-minute attack was a planned, deliberate, and orchestrated group assault involving Legault and other inmates.

The applicant brought a motion under sections 8 and 24(2) of the Canadian Charter of Rights and Freedoms to exclude evidence of accessing and possessing child pornography obtained pursuant to a search warrant.

The applicant challenged the warrant on grounds that it was based on misleading and unfounded information in the Information to Obtain.

The court found that the affiant made serious misstatements regarding the frequency and location of access to the PlayPen website, claiming multiple accesses from the applicant's residence when only one IP address observation existed with no evidence of child pornography access on that specific date.

Applying the Grant factors under section 24(2), the court excluded the evidence, finding the seriousness of the breach and its impact on privacy interests outweighed society's interest in adjudication on the merits.

Three appellants appealed their convictions for drug trafficking offences arising from Project O'Bunker, a large joint forces investigation in London, Ontario.

The appellants challenged the dismissal of their s. 11(b) Charter applications alleging unreasonable delay, and one appellant also challenged his conviction on the merits.

The Court of Appeal dismissed all appeals, finding that while the total delay of 39-40 months exceeded the presumptive ceiling of 30 months established in R. v. Jordan, the delay was justified by the exceptional complexity of the prosecution and the transitional exceptional circumstance based on reasonable reliance on the previous Morin framework.

The accused was charged with impaired driving contrary to section 253(1)(a) and (b) of the Criminal Code, and with having a blood alcohol concentration above zero while licensed as a novice driver contrary to section 44.1(3) of the Highway Traffic Act.

The accused, aged 24, consumed alcohol at a bar and then drove his father's vehicle through the Western University campus at excessive speed, striking and killing an 18-year-old first-year student.

The accused's blood alcohol concentration was 171 mg/100 mL, more than twice the legal limit.

The defence argued insufficient evidence of an agreement.

The court found that while there was no direct evidence of an agreement, the circumstantial evidence—including the accused's statement that "nothing comes through this place without me knowing," his phone call to arrange the delivery, and his approach to the vehicle before the transaction—established beyond a reasonable doubt that the accused and the co-conspirator had agreed to traffic in cocaine.

The accused was convicted.
