The applicant filed a human rights complaint alleging discrimination in employment on the basis of disability and family status, as well as reprisal.
The applicant, who suffered a back injury, alleged that the respondent employer failed to accommodate his medical restrictions, improperly required him to operate a forklift, permanently downgraded his position, and engaged in harassment and reprisal.
The Tribunal found that the employer breached the Code by directing the applicant to operate a forklift despite a medical note stating he was unable to do so, and by permanently re-classifying him without affording him an opportunity to attempt forklift operation as approved by his doctor.
All other allegations, including family status discrimination regarding cell phone use and reprisal in job competitions, were dismissed.
The Tribunal awarded $2,000 for injury to dignity, feelings, and self-respect.
