The respondent Toronto Police Services Board requested an order to strike out certain paragraphs of the Ontario Human Rights Commission's hearing brief.
The Tribunal reviewed the impugned paragraphs to determine if the facts alleged were potentially relevant to the matters at issue.
The Tribunal struck several introductory paragraphs that contained argument, premature requests, or irrelevant background information, as well as paragraphs relating to a prior unrelated complaint.
However, the Tribunal declined to strike paragraphs relating to post-incident matters, including a Police Services Act complaint and alleged missing evidence, finding them relevant to the issues of the respondent's response and credibility.
The Commission was ordered to file an amended hearing brief.
