Human rights application alleging failure to accommodate, racial discrimination, and reprisal dismissed for lack of evidence.
The applicant, a Muslim employee of Egyptian origin, alleged discrimination on the basis of creed, race, ancestry, and place of origin, as well as reprisal.
He claimed the respondent failed to accommodate his Friday prayer requirements, that his manager showed favouritism towards South Asian employees, and that his placement on a Performance Improvement Plan and subsequent termination were discriminatory and retaliatory.
The Tribunal dismissed the application, finding that the applicant's religious needs were appropriately accommodated, there was no evidence of racial discrimination or favouritism, and the performance management and termination were based on legitimate, documented performance issues.
The Tribunal also found the employer adequately responded to post-termination discrimination allegations.
