The appellant, Dave Marcotte, sought an extension of time to perfect his appeal of a divorce order, arguing the date of separation used in the proceedings was incorrect.

The Court of Appeal dismissed the motion, finding the appeal fundamentally misconceived because the proper forum for challenging the date of separation was a motion under r. 25(19) of the Family Law Rules in the Superior Court, which Mr. Marcotte had already commenced.

The court held that the appeal would be rendered moot by the outcome of that motion and that the merits of the appeal did not justify an extension of time.

Costs of $2,500 were awarded to the respondent, Christina Marcotte.

The Court of Appeal for Ontario granted the moving party, M.H., several orders following the administrative dismissal of O.K.'s family law appeal.

The court awarded costs for motions, declared the costs awards to be "support orders" under the Family Responsibility and Support Arrears Enforcement Act, 1996, and directed the issuance and enforcement of support deduction orders.

The decision clarifies the enforceability of costs awards as support orders and the process for their enforcement through the Family Responsibility Office.

The Court of Appeal for Ontario dismissed Susan Hutchison’s appeal from an order requiring her to pay spousal support to Matthew Bosrock and her application for leave to appeal the trial judge’s costs award.

The court also upheld the costs award, finding that the trial judge properly considered the divided success at trial and the time spent on the main issues.

The Court of Appeal for Ontario dismissed Adan McIntosh’s appeal from the dismissal of his motion to vary a parenting order.

The court found no material change in circumstances warranting a variation, emphasizing the ongoing risk of wrongful removal of the children to Australia and Mr. McIntosh’s failure to pay support and costs.

The court also addressed the children’s preferences, the financial and emotional impact of the litigation on Ms. Kim, and the principles governing variation of parenting orders.

This costs endorsement addresses the allocation of costs following a family law appeal in which the appellant, Eleanor Dawn Hendriks, was substantially successful.

The Court of Appeal for Ontario awarded her costs for both the appeal and the underlying motion, reversing the motion judge’s previous order that required her to pay costs to the respondent.

The court found that the appellant was the more successful party and that the respondent did not meet the burden to show his settlement offers were more favourable.

The court also found that the appellant, as a self-represented litigant, was not unreasonable in her conduct.

The Court of Appeal for Ontario dismissed the appeal of Vahid Mehdizadeh Asiyaban and 2468692 Ontario Ltd. against Halime Khatoun Aghdasi.

The trial judge had found that the appellant falsified evidence and solicited false testimony in support of a property claim in family litigation.

The Court held that the trial judge was entitled to reject the appellant’s uncorroborated evidence and found no basis to interfere with the credibility findings.

The appeal was dismissed in its entirety, and the appellant was ordered to pay costs to the respondent.

The Court of Appeal for Ontario granted a motion to quash an appeal in a family law matter concerning a motion for a sealing order and publication ban to protect a child’s privacy.

The court held that the order under appeal was interlocutory, not final, and thus any appeal lay to the Divisional Court with leave, not to the Court of Appeal.

The decision reviews the distinction between interlocutory and final orders, emphasizing that privacy and sealing orders are generally collateral to the main issues in family law proceedings and do not determine substantive rights.

The court also declined to reconstitute itself as the Divisional Court.

The Court of Appeal for Ontario considered a motion by the moving party, M.H., to adjourn and stay the appeal of O.K. until O.K. paid support arrears and security for costs.

The court found that O.K. was required to pay support for January to March 2025 and had not done so, and that he had no assets in Ontario and a history of failing to meet support obligations.

The court ordered the appeal stayed until O.K. paid $24,396 in support arrears and $35,000 as security for costs, with the appeal to be administratively dismissed if payment was not made by June 6, 2025.

The court also awarded M.H. $3,200 in costs for the motion.

The Court of Appeal for Ontario dismissed the appeal of Aliamisse O. Mundulai from a final order in a family law dispute with Ying Huang.

The appeal concerned parenting, property, and financial issues following the parties' separation.

The court found no reversible error in the trial judge’s decisions regarding the child’s therapy, beneficial ownership of an office unit, and the treatment of the respondent’s pension for equalization purposes.

Costs were awarded to the respondent.

The Court of Appeal for Ontario dismissed Manpreet Dhaliwal’s appeal from the trial decision and costs order in her family and civil actions against Hardeep Singh Nijher and his family.

The court found no legal or factual errors in the trial judge’s findings regarding property equalization, spousal support, and damages for intentional infliction of mental distress.

The trial judge’s credibility findings against the appellant were upheld, and the court found no evidence of bias or procedural unfairness.

Leave to appeal the costs order was also denied.

The Court of Appeal for Ontario granted leave for the former trial solicitor of Michael Scott De Longte to intervene in the appeal, limited to the issue of ineffective assistance of counsel.

The court found the solicitor’s participation necessary to complete the record and assist in the proper adjudication of the issue, as the allegations of ineffective assistance were central to the appeal and mirrored in a related professional negligence action.

The court also declared that solicitor-client privilege had been waived by Mr. De Longte and set out a schedule for the exchange and filing of fresh evidence, cross-examinations, and facta.

No costs were awarded on the motion.

The Court of Appeal for Ontario dismissed the appeal of Albert Edward Green from the order of Justice John Krawchenko regarding the division of property and spousal support following the breakdown of his marriage to Kristine Jill Hill.

The court upheld the trial judge’s findings on asset valuation, the application of the Family Law Act’s equalization mechanisms, and the denial of spousal support, finding no error in the trial judge’s approach or conclusions.

Costs of $35,000 were awarded to the respondent.

The Court of Appeal for Ontario allowed the appeal of A.A. regarding the return of her child to Bangladesh under the Children’s Law Reform Act (CLRA) while refugee applications were pending.

The court found that the motion judge erred by failing to consider the impact of the outstanding refugee claims, the allegations of domestic violence, and the potential for serious harm to the child if returned.

The decision clarifies that the existence of a refugee claim does not automatically stay CLRA proceedings but is a significant factor in the analysis.

The matter was remitted for a new hearing.

The Court of Appeal for Ontario dismissed the appeal of Terrence Chapman, who sought a 50% share in real estate and corporate assets held with Sandra Ing, his former partner in both business and personal life.

The trial judge found that the parties were not involved in a joint family venture and that Chapman would be unjustly enriched by an equal division, given Ing’s substantial contributions to the value of the property in question.

The Court of Appeal upheld the trial judge’s decision, finding no juristic reason for Chapman’s enrichment under the Ontario Business Corporations Act and confirming the appropriateness of a proprietary remedy in favour of Ing.

The Court of Appeal for Ontario dismissed the appeal of Dianne Pearl Douglas from a final order in a family law proceeding concerning parental decision-making, parenting time, and child support.

The appellant argued that the motion judge erred in finding a material change in circumstances and in determining that the respondent’s parenting time met the 40% threshold under the Federal Child Support Guidelines.

The Court found no error in the motion judge’s findings or application of the law, upholding the retroactive adjustment to child support and awarding costs to the respondent.

The Court of Appeal for Ontario dismissed Kirk Richard Iredale’s appeal from the Superior Court’s order regarding equalization of assets and spousal support following the breakdown of his marriage to Carol Jeanette Dougall.

The court held that the trial judge properly found the equalization payment remedied any unjust enrichment and that a time-limited spousal support award was appropriate.

The court also upheld the trial judge’s refusal to admit fresh evidence post-trial.

The Court of Appeal for Ontario dismissed a motion by Aliamisse O. Mundulai, who sought to set aside a decision refusing an extension of time to bring a panel review and to stay enforcement of certain paragraphs of a Superior Court order in a family law dispute.

The court found that the relevant rule (r. 63.01(1) of the Rules of Civil Procedure) applied, and that the moving party had not demonstrated irremediable hardship.

The responding party, Ying Huang, was awarded costs of $3,000.

The Court of Appeal for Ontario allowed Sheri Thom’s appeal in part, finding that the trial judge erred by imputing income to her for support purposes without considering the impact of family violence on her earning capacity.

The court upheld the trial judge’s decision to deny her request to relocate with her child to New Brunswick, finding no reversible error in the best interests analysis.

The court recalculated support obligations, holding that no income should be imputed to the appellant, and awarded her costs of the appeal.
