The National Council of Canadian Muslims (NCCM) moved to intervene as a friend of the court in the sentencing hearing of the defendant for contempt of court.

The court declined to add NCCM as an intervenor under Rule 13.02, noting the lack of precedent for public interest intervenors in criminal or contempt sentencing at first instance, and that the plaintiff had already raised the contextual arguments NCCM proposed to make.

However, recognizing NCCM's unique position to speak on the harm suffered by the Canadian Muslim community, the court authorized NCCM to file a Community Impact Statement by analogy to s. 722.2(1) of the Criminal Code.

The applicant and respondent purchased a house together as tenants in common.

The respondent moved out shortly after, and the applicant paid all mortgage and maintenance fees while living in the property rent-free.

After the property was sold, the applicant sought a declaration of unjust enrichment and a constructive trust, claiming 90% of the net proceeds.

The court dismissed the unjust enrichment claim, finding the applicant suffered no deprivation and there was a juristic reason to enforce their agreement to split proceeds equally.

The plaintiff, an unsophisticated lender, brought a motion for summary judgment to recover unpaid loans made to the defendants.

The defendants argued the acknowledgment of debt was unconscionable due to a 60 percent interest rate and lack of legal representation, and denied fraudulent misrepresentation.

The court granted summary judgment, finding no unconscionability as the defendant had proposed high interest rates initially and refused legal counsel.

The court also found the defendant engaged in fraudulent misrepresentation regarding the company's finances to induce the initial loans, awarding the plaintiff the principal amounts plus 60 percent interest.
