In a murder prosecution, the Crown brought a pre-trial application seeking to qualify a forensic document examiner as an expert in handwriting analysis to assist in establishing authorship of seized writings.

One accused opposed the application, arguing the proposed expert lacked sufficient qualifications and that her work had not been peer reviewed and used a different classification methodology than other forensic standards.

The court applied the test for admissibility of expert evidence from R. v. Mohan and held that the witness possessed the requisite specialized knowledge through education, training, and experience at the Centre of Forensic Sciences.

Concerns raised by the defence related to methodology and review processes went to the weight of the evidence rather than admissibility.

The witness was therefore qualified to provide opinion evidence in handwriting analysis.

The accused was convicted of second degree murder for stabbing his wife to death and nearly decapitating her.

The court determined the appropriate period of parole ineligibility.

The court rejected the accused's claims of profound depression and PTSD, finding him manipulative and lacking remorse.

Considering the brutal nature of the domestic homicide, the vulnerability of the victim, and the need for denunciation and deterrence, the court set parole ineligibility at 15 years.

In a murder trial, the accused sought a mistrial after the Crown’s opening address allegedly contained argument, rhetorical flourishes, and repetitive descriptions of the deceased’s injuries that were said to be inflammatory and prejudicial.

The court acknowledged that portions of the Crown’s opening exceeded the proper limits of a neutral overview and included some inappropriate commentary.

However, applying established principles governing mistrials, the court held that the improprieties were not so prejudicial that a jury would be incapable of disregarding them.

The court emphasized that mistrials are remedies of last resort and that juries are presumed to follow judicial instructions.

A corrective instruction to the jury was therefore sufficient to cure any potential prejudice.

The Attorney General of Canada, on behalf of Japan, applied to commit the respondent for extradition to face a charge of using a forged passport.

The respondent cross-applied for a stay of proceedings, arguing the extradition was an abuse of process because Japan's true motive was to interrogate him about an unsolved 1995 triple murder.

The respondent also sought to exclude evidence obtained from an accomplice who was on death row in China.

The court dismissed the cross-applications, finding that Japan's dual investigative and prosecutorial purposes did not constitute an abuse of process, and that the accomplice evidence was neither manifestly unreliable nor gathered abusively.

Finding sufficient evidence to establish a prima facie case and the respondent's identity, the court ordered the respondent committed for extradition.

The appellant appealed a summary conviction for refusing to provide a breath sample, arguing that the trial judge erred in refusing to stay proceedings for unreasonable delay under s. 11(b) of the Charter.

The appeal challenged the characterization of several periods of delay, including the interval between arrest and first appearance, the period from set date to trial, and the delay between trial dates when the trial did not conclude in one day.

The court held that the six‑week intake period between arrest and first appearance was reasonable and neutral.

Although the trial judge erred in attributing the entire period from set date to trial as institutional delay, the appellate court re‑assessed the delay and found that much of it reflected inherent case requirements.

The remaining delay did not reach a constitutionally unacceptable level, and the trial judge’s brief misstatement of the legal test did not undermine the correctness of the decision.

The appellant appealed a summary conviction for refusing to provide a breath sample into an approved roadside screening device during a Ride Program stop.

The appeal alleged that the trial judge misapprehended evidence concerning the appellant’s attempts to provide a breath sample and improperly rejected the appellant’s explanation for failing to provide a sufficient sample.

The appellant also alleged breaches of ss. 8 and 9 of the Canadian Charter of Rights and Freedoms relating to his detention and a strip search conducted prior to being lodged in cells overnight.

The court held that the trial judge did not misapprehend the evidence and was entitled to draw reasonable inferences regarding the appellant’s conduct.

The court further found that the detention was not arbitrary and that the strip search was justified on the individualized circumstances.

The appeal was dismissed.

The appellant appealed a sentence imposed after a guilty plea to possession of child pornography, arguing that the sentencing judge erred by refusing to grant a conditional discharge and by imposing a Sex Offender Information Registration Act order.

The appellant relied on mitigating factors including his status as a first offender, psychiatric evidence indicating a low risk of reoffending, and his cooperation with authorities which led to the prosecution of another offender.

The appeal court held that the sentencing judge committed no error in principle and properly considered all relevant factors.

The court also found that the appellant failed to demonstrate that the SOIRA registration requirement had a grossly disproportionate impact relative to its protective purpose.

The sentence and registration order were upheld.

In a joint first‑degree murder trial arising from a gang‑related shooting, the court considered whether the accused had put his character in issue through testimony denying gang affiliation and explaining incriminating letters written while in custody.

The court held that the accused’s narrative about his upbringing and alleged reluctance to join a gang implicitly asserted good character and therefore opened the door to cross‑examination on prior criminal conduct and gang‑related activity.

The court also ruled that certain previously redacted portions of letters written by the accused from custody could be admitted after reconsideration of a pre‑trial ruling, because the accused’s testimony materially altered the probative value of the evidence and risked misleading the jury.

The court concluded that the probative value of the additional passages outweighed their prejudicial effect and that severance of the co‑accused was not required.

In a first degree murder prosecution involving alleged gang rivalry, the accused applied to qualify a sociologist as an expert witness on street gangs.

The Crown opposed the qualification, arguing that the proposed expert lacked sufficient knowledge of the specific Toronto gangs at issue and that aspects of his methodology and impartiality were problematic.

The court conducted the two‑stage admissibility analysis for expert evidence under Mohan and Abbey, expressing significant concerns about the expert’s methodology, potential bias, inflated data samples, and limited familiarity with Toronto gangs.

Despite these reservations, the court held that the threshold for excluding defence expert evidence was not met and qualified the witness as an expert in limited areas relating to gang culture and behaviour.

The court then set detailed restrictions on the permissible scope of the expert’s testimony, particularly preventing opinions that would approach the ultimate issue of gang membership.
