The Crown appealed to the Supreme Court of Canada from a judgment of the Ontario Court of Appeal that dismissed its appeal from the accused's acquittal on charges of sexual assault.
The Supreme Court allowed the appeal and ordered a new trial, adopting the dissenting reasons of Rosenberg J.A. from the court below.
