The mother also sought a declaration that the father is a vexatious litigant.

The court found that the proposed move constituted a material change in circumstances but concluded that relocating to Michigan was not in the child's best interests, as it would disrupt the child's strong bonds with the father and extended family in Ontario.

The court dismissed the mother's request to relocate, dismissed the vexatious litigant claim, and adjusted the parenting schedule and section 7 expenses.

The plaintiff, Schindler Elevator Corporation, moved for the production of fully unredacted minutes of settlement between the defendants (WBP) and a third party (Yuanda).

WBP had produced a partially redacted version, claiming settlement privilege over the financial terms.

The court found that while the specific settlement amounts should remain privileged, other redacted information relevant to the apportionment of delay and quantification of damages must be disclosed to ensure procedural fairness at the upcoming trial.

The court ordered WBP to produce a further version of the minutes with only the specific settlement amounts and payment dates redacted.

The plaintiff brought a motion to validate service on a corporate defendant and to dispense with service on two individual defendants in an action for misappropriation of funds.

The court found that service on the corporate defendant was already effective under the Rules of Civil Procedure by mailing the claim to its registered address, making validation unnecessary.

The court declined to dispense with service on the individual defendants, finding the plaintiff had not exhausted all reasonable efforts to locate them, such as making inquiries at the criminal court counter, bringing a disclosure motion, or using a skip tracer.

The court extended the time for service on the individual defendants.

The client, Hui Yu, brought a motion seeking the production of his entire file and his daughter's entire file from his former lawyers, Gluckstein Personal Injury Lawyers P.C. The motion was brought in the context of an upcoming motion regarding the sufficiency of the lawyers' retainer and appropriate fees.

The client argued he needed the files to assess potential double billing and an extra fee charged on his daughter's file.

The lawyers opposed the request, arguing it was disproportionate, irrelevant, and an abuse of process.

The court granted the motion, finding that the files belonged to the client and that he was entitled to review them to determine relevancy and assess the fees charged.

The offender was convicted of 17 offences, including criminal harassment, uttering death threats, and extortion against his former common-law partner's family.

The Crown applied to have him designated a Dangerous Offender.

The court found that the predicate offences were serious personal injury offences and that the offender's conduct demonstrated a pattern of repetitive and persistent aggressive behaviour, showing a failure to restrain himself and a substantial degree of indifference to the consequences.

The court designated the offender a Dangerous Offender and, finding that a lesser sentence would not adequately protect the public due to his high risk of reoffending and poor treatability for Delusional Disorder and Antisocial Personality Disorder, imposed an indeterminate sentence.
