The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to revoke the liquor licence of Kenricia Properties Inc. and an order to immediately suspend the licence.

At a hearing on October 4, 2007, the Board adjourned the matter to October 22, 2007.

The Board ordered the licensee to disclose its witness list and evidence summaries to the Registrar's Representative by October 17, 2007, and ordered the Registrar's Representative to complete any further disclosure by the same date.

The applicant applied for a liquor licence to operate a premises known as Blue Moon.

The Registrar issued a Notice of Proposal to review the application based on concerns about the applicant's past conduct and failure to disclose his criminal history.

The Board found that the applicant failed to disclose his extensive criminal record in the United States and his deportation to Portugal on his application.

The Board concluded that the applicant's past conduct, including a history of criminal offences and alcohol-related issues, afforded reasonable grounds for the belief that he would not carry on business in accordance with the law and with integrity and honesty.

The application for a liquor licence was dismissed.

The Registrar issued a Notice of Proposed Order to refuse to renew the registration of Northwest Protection Services Ltd. as a non-gaming related supplier.

The refusal was based on the applicant's failure to facilitate a due diligence investigation by refusing to provide requested financial information, and its failure to disclose that a key employee had returned to work for the company.

The Board found that the applicant attempted to mislead the Commission regarding the employee's status and contravened the Gaming Control Act by refusing to provide relevant financial information.

The Board confirmed the proposal not to renew the registration.

Following the dismissal of the licensee's appeal by the Divisional Court, the Board of the Alcohol and Gaming Commission of Ontario ordered the 14-day suspension of the liquor licence for Armani's Nightclub to commence on January 2, 2008.

Following a finding that the licensee breached the Liquor Licence Act and its regulations, the Board previously ordered a 28-day suspension of the establishment's liquor licence and requested the licensee propose suspension dates.

The licensee proposed acceptable dates.

The Board ordered the 28-day suspension to commence on September 23, 2007, and conclude on October 21, 2007.

The Registrar sought a 35-day suspension of the Licensee's liquor licence after the Board found violations of the Liquor Licence Act for permitting drunken patrons.

The Licensee had recently served a 14-day suspension for similar infractions.

The Board considered the Licensee's decision to close the bar on nights when community dances were held as a mitigating factor.

A 28-day suspension was ordered as a specific and general deterrent.

The Registrar issued a Notice of Proposal to suspend the liquor licence of Thirty-Three & A Third Inc. (operating as The Swimming Pool) for alleged violations of the Liquor Licence Act and its regulations.

The parties submitted an Agreed Statement of Facts admitting that a fight occurred on the licensed patio and patrons removed liquor from the premises.

The Board found the licensee breached the regulations by permitting disorderly conduct and the removal of liquor.

Based on a joint submission, the Board ordered a 10-day suspension of the liquor licence.

The Registrar of the Alcohol and Gaming Commission of Ontario sought to revoke the liquor licence of Jamaica's Finest Restaurant and Bar following a finding of violations of O. Reg. 719/90, including issues of public safety, overcrowding, and the presence of guns on the premises.

The Licensee requested that the interim suspension be lifted and conditions imposed.

The Board found that the Licensee failed to assume responsibility for the serious and violent incidents that occurred on the premises and failed to ensure public safety and compliance with the Act.

The Board ordered the immediate revocation of the liquor licence.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the respondent motor hotel for alleged violations of the Liquor Licence Act and its regulations.

Following a hearing, the Board found that the licensee violated section 29 of the Act by serving alcohol to intoxicated patrons and section 45(1) of the regulations by permitting drunkenness and disorderly conduct on the premises.

The Board invited written submissions on penalty.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor delivery service licence of the licensee for delivering liquor to a place other than a residence and failing to properly complete liquor delivery receipts.

At the hearing, the parties submitted an Agreed Statement of Facts and a Joint Submission on Disposition.

The Board accepted the joint submission, finding that the licensee breached sections 15.4 and 15.5 of Ontario Regulation 718/90.

The Board ordered the licensee's liquor licence suspended for 21 consecutive days.

The Registrar of the Alcohol and Gaming Commission of Ontario sought to revoke and immediately suspend the liquor licence of Jamaica's Finest Restaurant and Bar following two police investigations.

The Board found that the licensee violated the regulations by permitting overcrowding, serving alcohol after hours, permitting the use of marijuana, and permitting violent and disorderly conduct, specifically a shooting incident inside the premises.

The interim suspension of the licence was ordered to remain in place pending submissions on penalty.

The Registrar issued a Notice of Proposal to suspend the liquor licence of Hoops Sports Bar & Grill, alleging the Licensee permitted disorderly conduct in violation of subsection 45(1) of Ontario Regulation 719/90.

The allegations stemmed from an incident where unknown individuals entered the establishment and started a fight.

The Board found that the incident was an unprovoked surprise attack and that the Manager responded quickly to control the situation and call for help.

The Board concluded that the Licensee did not permit the disorderly conduct and dismissed the alleged breach.

The Registrar of the Alcohol and Gaming Commission of Ontario issued Notices of Proposal to suspend the liquor licence of Penthouse Restaurant and Tavern and to refuse to remove certain conditions.

The parties submitted an Agreed Statement of Facts admitting that the licensee permitted drunkenness and failed to clear signs of service after hours.

Based on a Joint Submission on Disposition, the tribunal ordered a 14-day suspension of the liquor licence.

The tribunal also ordered the removal of absolute prohibitions on a dance floor and live music, replacing them with modified conditions allowing temporary setups for up to 12 special occasions per year with advance notice to police and the AGCO.

The Registrar issued a Notice of Proposal to revoke the licensee's liquor licence and an Order to immediately suspend it based on alleged violations of Ontario Regulation 719/90.

Following a hearing, the Registrar requested that the interim suspension continue until the Board makes a decision on the allegations.

The licensee consented to the request.
