O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a hearing on May 17, 2006 pursuant to a Notice of Proposal dated September 15, 2005 to suspend the liquor licence issued to 1204745 Ontario Limited operating as ARMANI’S NIGHTCLUB, 513 East Victoria Ave., Thunder Bay, Ontario, P7C 1A8, licence number 802070;
AND WHEREAS in its decision of June 30, 2006 the Board found that the licensee had breached subsection 45(1) of Ontario Regulation 719/90 under the Liquor Licence Act and in its decision of August 2, 2006, the Board ordered a liquor licence suspension for fourteen (14) consecutive days;
AND WHEREAS the licence holder appealed the Board’s decision to the Ontario Superior Court of Justice (Divisional Court) and by an Order, the Court stayed the period of suspension of the licence pending the outcome of the appeal;
AND WHEREAS the appeal was dismissed by the Divisional Court by an Order dated December 5, 2007;
AND WHEREAS the Licensee has proposed suspension dates to the Court which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the liquor licence issued to 1204745 Ontario Limited operating as ARMANI’S NIGHTCLUB, 513 East Victoria Avenue, Thunder Bay, Ontario, P7C 1A8, licence number 802070 be SUSPENDED for fourteen (14) consecutive days to COMMENCE at 11 a.m. on January 2, 2008 and continue until 2 a.m. on January 16, 2008.
