Following a hearing, the Board found the Licensee in violation of section 29 and subsection 25(1) of Ontario Regulation 719/90 and ordered a five-day suspension of its liquor licence.

The Licensee proposed suspension dates that were acceptable to the Board.

The Board found that the licensee did not permit drunkenness, fail to post its licence, or fail to facilitate an inspection, as the owner's symptoms were likely due to a head injury and the police initially attended for an assault rather than an inspection.

However, the Board found violations for selling or serving liquor outside prescribed hours and failing to clear signs of service, based on police observations of cold beer and ice cubes in the darkened banquet room after 4:00 a.m.

The Board invited written submissions on penalty.

The request was unopposed by the Registrar and the applicant.

The Board granted the objector party status and ordered all parties to make disclosure ten days before the scheduled hearing.

The Board previously found that the Licensee, Central Bar & Grill Ltd., violated section 43 of Ontario Regulation 719/90 and ordered a 14-day suspension of its liquor licence.

The Licensee proposed suspension dates which were acceptable to the Board.

The Board ordered the 14-day suspension to commence on August 29, 2009, and continue until September 12, 2009.

At a pre-hearing teleconference regarding a liquor sales licence application by Azores Cultural Community Centre (Canada), the Board of the Alcohol and Gaming Commission of Ontario considered a request for party status by an objector.

With no opposition from the parties, the Board granted party status to the objector.
