The responding parties failed to file a response to the application.
Pursuant to Rule 41 of the Board's Rules of Procedure, the Board deemed the responding parties to have accepted the facts alleged in the application and declared them to be a single employer bound by the applicable collective agreement.
The Board declined to grant default judgment on the grievance referral, as it was commenced prior to the enactment of the default judgment provisions, and directed that the scheduled hearing proceed.
