DECISION OF THE BOARD; January 10, 2000
1The Board has received correspondence from counsel for the applicant. In part, the letter makes reference to certain statements allegedly made or undertakings given during the course of settlement discussions. Although the parties agreed to request the assistance of the two members of this panel during settlement discussions, this should not be taken as an invitation to report back to the Board formally on portions of these discussions.
2The letter also refers to production orders made in the Board’s decision of October 5, 1999. The first date on which documents must be exchanged is January 14, 2000. That date has not yet arrived. If one party is clearly unwilling or unable to comply with the order, or any portion of it, the other may write to the Board after the date has passed seeking any necessary or appropriate additional orders. Since the purpose of the exchange of documents is to facilitate the litigation, parties seeking further relief might choose to start slightly lower on the scale of potential remedies than a request for a warrant.
