The parties reached a settlement.

Based on uncontested expert planning and heritage evidence, the Tribunal found the proposed development represents appropriate intensification, is consistent with provincial and municipal policies, and respects the heritage character of the area.

The appeals were allowed in part and the instruments approved in principle, with the final order withheld pending the final form of the Zoning By-law Amendment.

The applicant appealed the City of Niagara Falls' failure to make a decision on applications for an Official Plan Amendment and Zoning By-law Amendment to permit a 10-storey mixed-use building.

The subject property is located adjacent to the Battlefield Museum, a recognized heritage site.

The Tribunal found that the proposed development's height, mass, and scale would overwhelm the adjacent heritage property and did not conform with the City's Official Plan policies regarding compatibility and transition.

The Tribunal preferred the evidence of the City's planners and heritage experts, concluding the proposal was an overbuild that did not represent good planning.

The appeals were dismissed.

The applicant appealed the City of Mississauga Committee of Adjustment's refusal of minor variances to permit an A&W take-out restaurant with a drive-through as an accessory use to an existing gas station, and to reduce landscape buffers.

The City argued the restaurant was a principal use due to its size and operational independence.

The Tribunal found the restaurant remained an accessory use, noting it occupied only 25% of the kiosk area and did not dominate the primary gas bar function.

The Tribunal allowed the appeal, finding the variances met the four-part test under s. 45(1) of the Planning Act, were consistent with the Provincial Policy Statement, and represented good planning without the need for conditions.

The applicant appealed the Township of Lake of Bays' refusal of a site-specific zoning by-law amendment to permit increased lot coverage and shoreline activity area coverage for a floating dock addition.

The Township did not appear at the hearing.

Based on the uncontroverted expert planning evidence that the proposal is consistent with planning policies, compatible with the surrounding area, and represents good planning, the Tribunal allowed the appeal and amended the zoning by-law.

The appellant appealed the Committee of Adjustment's refusal of consent and minor variance applications to permit the severance of a corner lot and the construction of semi-detached dwellings with additional residential units.

The Tribunal allowed the appeals in part, granting provisional consent and authorizing variances for lot area, frontage, coverage, exterior side yard setback, and eave height, finding they met the tests under s. 45(1) of the Planning Act and respected the neighbourhood's eclectic character.

However, the Tribunal refused the variance to reduce the required parking spaces from two to one, citing a lack of justification and potential neighbourhood impact.

The Tribunal also upheld a standard municipal condition requiring an acoustical report due to the property's proximity to railway tracks.

The appellants appealed the Township of Georgian Bay's Amending By-law No. 2025-053 (a housekeeping by-law) under subsection 34(19) of the Planning Act.

The parties reached a full uncontested settlement.

Based on the uncontradicted planning evidence, the Tribunal found that the revised by-law contains only clarificatory and editorial amendments, is consistent with the Provincial Planning Statement, conforms to the applicable Official Plans, and represents good planning.

The appeal was allowed in part to amend the by-law in accordance with the settlement.

The applicants sought an order under the Mining Act to cancel a note of pending proceedings on several mining claims.

The Tribunal previously found the application premature as it lacked sufficient evidence that the underlying litigation against the respondent had been discontinued.

The applicants subsequently provided documentation confirming that the respondent had changed its corporate name and that the litigation had been wholly discontinued.

Satisfied that the litigation was resolved, the Tribunal ordered the cancellation of the note of pending proceedings, excluded the time the note was in effect from the computation of time for assessment work, and set a new anniversary date for the claims.

At a Case Management Conference regarding appeals of the City of Burlington's Official Plan Amendment 2, the Tribunal granted party status to Aliena Land Corporation et al. and Sofina Foods Inc. The Tribunal also issued a supplementary order on consent, scoping the appeals of Canadian National Railway Company, Bull Moose Tube Limited, and Manor Care, and adjourning the Manor Care appeals pending the processing of a site-specific development application.

The Tribunal convened a settlement hearing regarding appeals of Official Plan Amendment No. 409 and Zoning By-law 702-2024, which regulate development on Ookwemin Minising (formerly Villiers Island) in Toronto's Port Lands.

The modifications address building heights, density, land uses, and meanwhile uses.

Based on the uncontroverted expert planning evidence, the Tribunal found the settlement represents good planning, is consistent with the Provincial Policy Statement, and conforms with the applicable Official Plan.

The appeals were allowed in part to implement the settlement.

The appellants appealed the City of Hamilton's approval of Zoning By-laws Nos. 24-051 and 24-052, which introduced new electric vehicle parking standards.

The parties reached a settlement and presented uncontested expert evidence in land use planning and transportation engineering supporting the proposed amendments.

The Tribunal found the amendments, including transition provisions for recent zoning approvals, represented good planning, were consistent with the Provincial Planning Statement, and conformed to the applicable official plans.

The appeals were allowed in part to amend the zoning by-law in accordance with the settlement.

The Tribunal held a fifth Case Management Conference regarding appeals of the District's approval of the new Township of Muskoka Lakes Official Plan.

The parties disputed the contents of the Issues List.

The Appellants sought to include policies related to aggregates, rural and resource management, transportation, and water, arguing the Provincial Planning Statement must be read in its entirety.

The District and added parties argued the Issues List should be restricted to issues specifically named in the Notices of Appeal, consistent with a prior Tribunal order.

The Tribunal agreed with the District, finding its Issues List best complied with the prior order and provided a fair and just process.

A 13-day hearing on the merits was scheduled for February 2027, and a Procedural Order was issued.

The Ontario Land Tribunal held a Case Management Conference regarding appeals of the City of Guelph's new Comprehensive Zoning By-law and related Official Plan Amendment No. 88.

The Tribunal approved a partial settlement between the City and the Guelph & District Home Builders’ Association, finding it represented good land use planning and was consistent with provincial policies.

The Tribunal also established a Procedural Order and scheduled a three-week merits hearing for the remaining appeals.
