THESE MATTERS having come before the Ontario Land Tribunal (the “Tribunal”) and the Tribunal issued its Decision on May 22, 2025 following a settlement hearing allowing the Zoning By-law Amendment to By-law No. 2009-0145 and draft Plan of Subdivision in part;
AND THE TRIBUNAL having received, on consent of the Parties, a request for approval of minor revisions to the Zoning By-law Amendment, draft plan of subdivision in relation to the lands known as 75 Woolwich Street East, Part of Lot 16, Concession 11, in the Township of Centre Wellington;
AND THE TRIBUNAL having been advised that the revisions to the development are:
- The park size has been increased from 0.63 ha to 0.65ha and has been relocated from the southern end of the plan to a more central location along the western boundary
- A link/semi-detached product has been introduced, increasing the variety of product types within this plan. The overall number of units has not changed. (see summary table below for full comparison)
- Minor internal road network changes however the principal access points from Marr Drive and Irvine Street have been maintained
- A 14m wide walkway has been introduced north of the current walkway block
- The walkway block connecting to Woolwich Street East has been increased in size along the Woolwich Street frontage in order to create more of an urban square environment

THE TRIBUNAL ORDERS that the revised Zoning By-law Amendment, is hereby approved as attached to this Order as Attachment 1 and the Clerk of the Township is hereby authorized to assign numbers to, insert any applicable dates, and format as may be necessary for recordkeeping purposes;
THE TRIBUNAL ORDERS that the draft Plan of Subdivision, is hereby approved as attached to this Order as Attachment 2;
AND THE TRIBUNAL FURTHER ORDERS that pursuant to subsection 51(56.1) of the Planning Act, the County of Wellington shall have the authority to clear the conditions of draft plan approval and to administer final approval of the plan of subdivision for the purposes of subsection 51(58) of the Act. In the event that there are any difficulties implementing any of the conditions of draft plan approval, or if any changes are required to be made to the draft plan, the Tribunal may be spoken to.
