The Ontario Land Tribunal issued a procedural order on consent to govern the proceedings for a determination of compensation under the Expropriations Act between Tagumpay Trading Company Limited and Metrolinx.

The order sets out the timetable for pre-hearing steps, including document exchange, mediation, discovery, and expert witness meetings, leading up to a five-day video hearing scheduled to commence on September 14, 2026.

The Ontario Land Tribunal held a Case Management Conference regarding appeals of a zoning by-law amendment, official plan amendment, and draft plan of subdivision for a proposed residential development in Woodstock.

The statutory parties advised that a settlement had been reached.

The Tribunal considered requests for Party and Participant status.

John Bell's request for Party status was denied as there were no remaining issues to shelter under given the settlement, and his participation as a Party would cause prejudice through increased hearing length and cost; he was granted Participant status instead.

The Tribunal granted Participant status to 85 other requestors, ordered the matters to be heard together, and scheduled a settlement hearing.

The applicant appealed the City of Vaughan's failure to adopt requested Official Plan and Zoning By-law amendments to facilitate a mid-rise mixed-use development.

Following an interim order, the parties confirmed that the required conditions, including the finalization of the amendment instruments and submission of updated reports, were satisfied.

The Ontario Land Tribunal allowed the appeals in part, approving the Official Plan and Zoning By-law amendments, while adjourning the site plan appeal sine die.

The parties resolved all matters pertaining to compensation under the Expropriations Act, except for the amount of reasonable legal, appraisal, and other costs incurred by the claimant.

On consent, the Ontario Land Tribunal ordered that the determination of costs payable by the statutory authority to the claimant be referred to an assessment officer in accordance with subsection 32(1) of the Expropriations Act.

The claimant sought compensation for injurious affection and disturbance damages under the Expropriations Act.

The Ontario Land Tribunal issued a fresh as amended procedural order to govern the upcoming five-day video hearing, replacing the previous procedural order issued in February 2021.

The appellant appealed the City of Ottawa's Zoning By-law 2017-275 to the Ontario Land Tribunal.

Prior to a hearing, the City of Ottawa passed a motion repealing the subject by-law.

Upon receiving notice of the repeal, the Tribunal ordered under its own motion pursuant to section 9(1) of the Ontario Land Tribunal Act that the by-law is repealed and closed the case.

The applicant appealed the Town of East Gwillimbury's failure to make a decision on applications for a Zoning By-law Amendment and Draft Plan of Subdivision to permit the development of 15 single detached dwellings and 16 townhouse dwellings.

The Ontario Land Tribunal allowed the appeals in part, approving the Zoning By-law Amendment and the Draft Plan of Subdivision subject to conditions.

The Tribunal returned the authority to give final approval for the Plan of Subdivision to the Town.

The appellant appealed the City of Toronto's failure to make a decision on Official Plan and Zoning By-law Amendment applications to permit a 14-storey residential building, an increase from an approved 11-storey building.

The parties reached a settlement prior to the hearing.

Based on uncontested expert planning evidence, the Tribunal found the proposed intensification near a major transit station area was consistent with provincial policies and constituted good planning.

The Tribunal allowed the appeals and approved the amendments in principle, withholding its final order pending the fulfillment of conditions including a section 37 agreement.
