THIS MATTER having come before the Tribunal to determine compensation on an application by Trimterra Development Corporation;
AND THE PARTIES having advised the Tribunal that all matters pertaining to the amount of compensation payable pursuant to the Expropriations Act, R.S.O. 1990, c. E 26 (the “Act”) have been resolved but that the amount which the City should be required to pay in respect of the reasonable, legal, appraisal and other costs incurred by the Claimant for the purpose of determining compensation remains in dispute;
THE TRIBUNAL ORDERS on the consent of the Parties:
The Tribunal hereby orders that the determination of the amount of costs to be paid by the City of Ottawa, as the statutory authority, to Trimterra Development Corporation is referred to an assessment officer who shall assess and allow costs in accordance with subsection 32(1) of the Act.
The Tribunal file is closed.
