Income replacement benefit claim dismissed as statute-barred and for failing to establish eligibility within 104 weeks.
The applicant was injured in a motor vehicle accident and sought an income replacement benefit (IRB) more than three years later, after her condition deteriorated.
The insurer denied the claim on the basis that she did not suffer a substantial inability to perform the essential tasks of her employment within 104 weeks of the accident, as required by s. 5(1) of the Statutory Accident Benefits Schedule, and that the claim was statute-barred under s. 56 because she failed to dispute a valid denial within the two-year limitation period.
The Tribunal agreed with the insurer, finding that the discoverability rule did not apply to save the claim where the substantive right to an IRB was not established within the initial 104-week period.
The application was dismissed as statute-barred.
