The applicant, a union representative, filed a human rights application alleging his termination was discriminatory and a reprisal.
The respondents requested dismissal under section 45.1 of the Human Rights Code, arguing the substance of the application was already dealt with in a grievance arbitration that reinstated the applicant.
The Tribunal found that the applicant had a full opportunity to raise human rights issues during the arbitration but failed to do so.
Applying the Supreme Court's principles in Figliola, the Tribunal held that permitting the application to proceed would result in relitigation and deny finality.
The Tribunal also found the Charter did not apply to the private employer.
The application was dismissed.
