The Registrar of the Alcohol and Gaming Commission of Ontario sought to revoke the liquor licence of Tropix Restaurant & Lounge following an incident involving a fight and a firearm on the premises.

The Licensee admitted to keeping off-licence liquor for sale.

The Board found that the Licensee's security staff acted reasonably and swiftly to quell the fight and that the Licensee had reasonable measures in place to deter disorderly conduct.

The allegations of permitting disorderly conduct and failing to deter disorderly conduct outside the premises were dismissed.

A finding was made against the Licensee for the off-licence liquor infraction, with penalty submissions to follow.

The Alcohol and Gaming Commission of Ontario held a pre-hearing teleconference regarding an appeal by Vansram Limited of an Order of Monetary Penalty in the amount of $2,100.

The Board ordered both the licensee and the Registrar to complete mutual disclosure of witnesses and evidence summaries at least 10 days prior to the scheduled hearing date.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to revoke the licensee's liquor licence and an interim suspension order based on alleged violations of the Liquor Licence Act and regulations.

At the hearing, the Registrar withdrew the allegation under subsection 45(2) of the Act, and the licensee admitted to a breach of subsection 31(1)(c) of the regulations.

The licensee brought a motion to lift the interim suspension and presented a plan to upgrade management and address public safety concerns.

The Board ordered the interim suspension rescinded, subject to several conditions including age restrictions, security personnel requirements, and video surveillance.

At the hearing, the parties submitted an Agreed Statement of Facts admitting to multiple instances of overcrowding and an incident where the manager was intoxicated, belligerent, and locked police out of the premises.

The Board accepted the joint submission, ordering the continuation of the licence suspension until September 8, 2009, and imposing conditions including a prohibition on staff consuming alcohol before or during shifts, a requirement to serve drinks in plastic cups, and the delivery of a trespass letter to the local police.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to revoke the liquor licence of Albert's Hotel, alleging violations of s. 6(2)(d) of the Liquor Licence Act and s. 45(2) of O.Reg 719/90 relating to drug trafficking on the premises.

Following a police raid that uncovered significant quantities of cocaine and other drugs in rooms adjacent to the licensed area, the Board found that the Licensee permitted the distribution of controlled substances by giving a known drug trafficker free access to the hotel as a handyman.

The Board found a violation of s. 45(2) of the Regulation but dismissed the allegation under s. 6(2)(d) of the Act, noting the Licensee's cooperation and subsequent remedial measures.

Written submissions on penalty were invited.

A resident objector, Misha Glouberman, requested party status in a hearing regarding a liquor licence application by A.C. Great Hall Management Inc. The Registrar and the Applicant consented to the request.

The Alcohol and Gaming Commission of Ontario granted the objector party status and ordered immediate disclosure of documents and witness lists by all parties.

At a pre-hearing teleconference regarding a liquor sales licence application by Azores Cultural Community Centre, an objector requested party status.

The request was unopposed by the Registrar and the applicant.

The Board granted the objector party status and ordered all parties to make disclosure ten days before the scheduled hearing.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to revoke and suspend the liquor licence of the respondent nightclub after a patron brought a firearm into the premises and discharged it.

Following an Agreed Statement of Facts and a Joint Submission on Disposition, the Board found the licensee breached section 45.2 of Ontario Regulation 719/90.

The Board ordered a five-day suspension of the liquor licence and imposed extensive security and operational conditions on the licence.

The allegations involved permitting an underage patron to have liquor, failing to inspect identification, and permitting drunkenness and disorderly conduct during an incident where a female patron assaulted a police officer.

The Board dismissed all allegations, finding that the licensee's staff had properly inspected the minor's false identification, did not knowingly permit the minor to have liquor, and had intervened appropriately to remove the allegedly intoxicated patrons before the situation escalated due to police intervention.

The Registrar issued a Notice of Proposal to revoke the liquor licence of the Park Hotel following the execution of a search warrant that resulted in the seizure of drugs and the arrest of a co-owner for drug trafficking.

The Licensee conceded that a violation of subsection 45(2) of Ontario Regulation 719/90 occurred.

After considering the evidence of ongoing drug-related and violent incidents at the premises, and the fact that the offending co-owner was allowed to continue working until shortly before the hearing, the Board ordered the immediate revocation of the liquor licence.

The Licensee requested an adjournment of a hearing regarding a Notice of Proposal to suspend its liquor licence.

The Registrar was prepared to proceed.

The Board granted the adjournment, making the next hearing date peremptory upon the Licensee, and ordered the Licensee to provide witness lists and evidence summaries to the Registrar ten days before the next hearing date.
