O R D E R
WHEREAS a hearing before the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”), pursuant to Notice of Proposal (“NOP”) number 16733 dated October 20, 2008, to suspend liquor licence number 20638 issued to 6477291 Canada Inc. operating as HOOLEY’S RESTAURANT, 292 Elgin Street, Ottawa, Ontario, K2P 1M3, was scheduled to commence on April 8, 2009;
AND WHEREAS the Registrar’s Representative, Richard Kulis, and Dale Hill, the principal of the corporate licensee, were present to participate in the hearing;
AND WHEREAS the Licensee requested an adjournment of the hearing while the Registrar was prepared to proceed on the scheduled date;
AFTER considering the Licensee’s and the Registrar’s counsel’s submissions with respect to the adjournment request:
THEREFORE the Board hereby ORDERS as follows:
The matter is adjourned, peremptory upon the Licensee, to a date to be set by the Hearings Case Management Co-ordinator; and,
The Licensee, or through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the next hearing date.
