Tribunal awards $39,868 to bartender for severe sexual harassment, discriminatory termination, and post-employment stalking.
The applicant, a bartender, alleged that the individual respondent, the owner and manager of the bar, subjected her to sexual harassment, poisoned her work environment, and terminated her employment as a reprisal for rejecting his sexual advances.
Following her termination, the respondent engaged in stalker-like behaviour, delivering misogynistic letters to her home and threatening physical violence.
The Tribunal found that the respondent's conduct constituted sexual harassment, discrimination based on sex, and reprisal under the Human Rights Code.
The Tribunal awarded the applicant $35,000 for injury to dignity, feelings, and self-respect, and $4,868.86 for lost income, and ordered the respondent to undergo human rights training.
