DECISION
Adjudicator: Ken Bhattacharjee
Indexed as: Concessio v. TD Waterhouse
1On September 26, 2012, the applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, which alleged that the respondent discriminated against her with respect to employment.
2On November 27, 2012, the respondent filed a Response, which requested that the Tribunal dismiss the Application because it falls within federal, not provincial, jurisdiction.
3On November 28, 2012, the Tribunal delivered the Response to the applicant. In its covering letter, the Tribunal notified the applicant that she must respond to the respondent’s request to dismiss her Application by no later than December 12, 2012, and that if she failed to do so, the Tribunal may dismiss her Application as abandoned.
4The applicant has not responded to the respondent’s request to dismiss her Application, and the time for doing so has passed.
5In the circumstances, the applicant is deemed to have abandoned the Application, and the Application is dismissed.
Dated at Toronto, this 6th day of February, 2013.
