The applicant filed a human rights application alleging that the Ontario Provincial Police discriminated against her on the basis of disability, creed, family status, and marital status during various interactions between 2010 and 2016.
The Tribunal held a preliminary hearing to determine whether the application should be dismissed for delay and for having no reasonable prospect of success.
The Tribunal found that the allegations relating to incidents in 2010 were out of time and the applicant failed to establish that the delay was incurred in good faith.
For the remaining allegations, the Tribunal concluded there was no reasonable prospect of success because the applicant failed to point to any evidence that her disability, creed, family status, or marital status was a factor in how the police treated her during their investigations, child apprehensions, and subsequent criminal charges.
The application was dismissed.
