The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of Hooley's Restaurant for alleged violations of the Liquor Licence Act and its regulations.

Following a hearing, the Board found that the Licensee violated the Act and regulations by encouraging immoderate consumption through a free alcohol promotion, supplying alcohol to intoxicated patrons, permitting unauthorized alcohol to be consumed on the premises, and permitting drunkenness.

The Board dismissed an allegation that the Licensee failed to facilitate an inspection.

The Board invited written submissions on penalty.

The Registrar issued a Notice of Proposal to suspend the respondent's liquor licence for alleged violations of the Liquor Licence Act and its regulations.

Inspectors observed a patron displaying obvious signs of intoxication who was served alcohol and who carried alcohol across an unlicensed area.

The respondent claimed the patron was only tired and drinking orange juice, but admitted the inspector's observations were correct.

The Board found the respondent violated the Act and regulations, and invited submissions on penalty.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to refuse to renew the liquor delivery licence of the licensee.

The proposal was based on alleged violations of sections 6(2)(a), (d), and (e) of the Liquor Licence Act, stemming from the licensee's failure to disclose past criminal convictions and bankruptcies on his Personal History Reports.

The Board found that the licensee's significant past debt, recent criminal convictions for sexual assault, and admission to making false statements on his applications demonstrated a lack of financial responsibility, honesty, and integrity.

The Board concluded that the licensee violated the Act and ordered that the licence not be renewed.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of Hotel Boutique Lounge Inc. based on alleged violations of the Liquor Licence Act and its regulations.

The parties submitted an Agreed Statement of Facts and a Joint Submission on Disposition, admitting that on December 16, 2006, there were two drunken patrons in the licensed premises, breaching s. 45(1) of O. Reg. 719/90.

The Board accepted the joint submission and ordered a 21-day suspension of the liquor licence.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the respondent's liquor licence.

The parties submitted an Agreed Statement of Facts admitting that two drunken patrons and an intoxicated bartender were present in the licensed premises, and the bartender was belligerent with police.

The Board found the licensee breached subsection 45(1) of the Liquor Licence Act.

Accepting the joint submission on disposition, the Board ordered a 12-day suspension of the liquor licence.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the respondent following a fight between two patrons.

The licensee admitted to the facts and the violation of subsection 45(1) of O. Reg. 719/90.

The Board accepted the joint submission and ordered a 21-day suspension of the liquor licence.

The Registrar issued a Notice of Proposal to suspend the licensee's liquor licence for alleged violations of the Liquor Licence Act, specifically permitting a minor to consume liquor and allowing a drunken patron on the premises.

The parties submitted an Agreed Statement of Facts admitting to the violations and a Joint Submission on Disposition.

The Board accepted the joint submission and ordered a 17-day suspension of the liquor licence.

The Alcohol and Gaming Commission of Ontario issued an order suspending the liquor licence of 123963 Ontario Limited, operating as Sin City Bar & Eatery, for ten consecutive days.

The suspension follows previous Board decisions finding the licensee breached subsection 45(1) of Ontario Revised Regulation 719/90 and ordering a ten-day suspension.

The Board accepted the suspension dates proposed by the licensee, ordering the suspension to commence on November 11, 2007, and continue until November 21, 2007.

The applicant applied for a liquor delivery service licence.

The Registrar issued a Notice of Proposal to refuse the licence based on the applicant's past conduct as a driver for another delivery service, Puss & Boots, whose licence had been revoked.

The Board found that the applicant had delivered liquor to a highly intoxicated individual, falsified delivery records to conceal the nature of the deliveries, and made unauthorized deliveries to licensed establishments.

The Board concluded there were reasonable grounds to believe the applicant would not carry on the business in accordance with the law and with integrity and honesty.

The application was refused.

Following a finding that the licensee breached the regulations by permitting an intoxicated patron on the premises, the Board held a hearing on sanction.

The Registrar sought a suspension, noting a prior similar infraction.

The licensee argued due diligence and pointed to numerous clean inspections.

The Board imposed a 10-day licence suspension, emphasizing the need for progressive discipline given the prior infraction within two years, and strongly urged the licensee to implement written policies for dealing with intoxicated patrons.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the respondent licensee for permitting the consumption of liquor after hours.

The parties submitted an Agreed Statement of Facts admitting the violation of subsection 25(1) of O. Reg. 719/90, and a Joint Submission on Disposition proposing a 21-day suspension.

The Board accepted the joint submission and ordered a 21-day suspension of the liquor licence.

The Registrar issued a Notice of Proposal to suspend the liquor licence of Cactus Pete's Bar and Grill for an alleged violation of subsection 45(1) of Ontario Regulation 719.

During the hearing, after the Registrar's witnesses testified, the Registrar requested to withdraw the Notice of Proposal.

The licensee consented.

The Board allowed the request and the Notice of Proposal was withdrawn.

The applicant applied for a liquor licence for a restaurant located at a premises with a history of drug dealing, prostitution, and violence under a previous owner.

The City of Toronto and local residents opposed the application, arguing that granting a licence would attract the same criminal elements that had plagued the area before the previous licence was revoked.

The Board found that the applicant lacked the experience to control the anticipated problematic clientele.

Concluding that issuing the licence was against the public interest having regard to the needs and wishes of the residents, the Board refused the application under s. 6(2)(h) of the Liquor Licence Act.

The applicant applied for a liquor licence for a proposed nightclub in the entertainment district.

The Registrar and local residents objected, arguing that the area was already saturated with nightclubs and that the principal's past conduct, which included a tax conviction and drug trafficking allegations in New York, demonstrated a lack of integrity.

The Board found that the objectors failed to prove that granting the licence was contrary to the public interest, noting the unique nature of the proposed facility and the lack of engagement by the residents' association.

The Board also found that the principal had demonstrated a commitment to operating the business in accordance with the law.

The application was approved subject to conditions.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor delivery service licence of the licensee for delivering liquor to a place other than a residence and failing to properly complete liquor delivery receipts.

At the hearing, the parties submitted an Agreed Statement of Facts and a Joint Submission on Disposition.

The Board accepted the joint submission, finding that the licensee breached sections 15.4 and 15.5 of Ontario Regulation 718/90.

The Board ordered the licensee's liquor licence suspended for 21 consecutive days.

The licensee requested an amendment to a previous Board order to change the dates of a 28-day liquor licence suspension due to business conditions.

The Registrar's representative did not object.

The Board granted the request and amended the suspension dates to run from July 16, 2007, to August 13, 2007.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the Licensee for allegedly permitting liquor to be sold to intoxicated persons and permitting drunkenness on the premises on two separate dates.

The Board found no violation for the first date due to inconsistencies in the inspector's evidence and lack of proof of intoxication or sale.

However, based on unrefuted evidence from two undercover inspectors regarding the second date, the Board found that the Licensee permitted drunkenness on the premises.

The Board requested written submissions on the appropriate sanction.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of Centrinium Food & Beverage Service Inc., operating as The James Joyce Irish Pub.

The parties proceeded by way of an Agreed Statement of Facts and Joint Submission on Disposition, admitting that a drunken patron was permitted on the premises contrary to subsection 45(1) of Ontario Regulation 719/90.

The Board accepted the joint submission and ordered a four-day suspension of the liquor licence.

The Registrar issued a Notice of Proposal to revoke the liquor licence of Mr. Bob's Gourmet Pizza following incidents where an undercover officer purchased cocaine from a waitress and received Percocet from a patron and employee.

At the hearing, the parties presented an Agreed Statement of Facts and a Joint Submission on Disposition.

The Board found the licensee breached s. 45(2) of O. Reg. 719/90 and ordered a 25-day licence suspension along with several conditions regarding employee screening and cash handling.

The Board previously found that the licensee violated section 43 of O. Reg. 719/90 under the Liquor Licence Act and ordered a five-day suspension of its liquor licence.

The licensee proposed suspension dates which were acceptable to the Board.

The Board ordered the five-day suspension to commence on June 23, 2007.
