The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the respondent licensee for failing to clear signs of service and consumption of liquor after hours, and for permitting drunken patrons on the premises.

The parties submitted an Agreed Statement of Facts and a Joint Submission on Disposition.

The Board found the licensee breached section 29 and subsection 45(1) of O.Reg 719/90 and ordered a 28-day suspension of the liquor licence.

Following a finding that the licensee violated section 43 of O. Reg. 719/90 by exceeding the capacity of its licensed premises, the Board held a hearing to determine the appropriate sanction.

The Registrar sought a 7-day suspension, noting prior warnings and the licensee's admission of knowingly exceeding capacity.

The licensee highlighted its flawless operating record.

Emphasizing the seriousness of overcrowding violations and the need for general deterrence, the Board imposed a 5-day suspension of the liquor licence.

Following the dismissal of the licensee's appeal by the Divisional Court, the Board of the Alcohol and Gaming Commission of Ontario ordered the 28-day suspension of the liquor licence for the Royal Hotel to commence on July 2, 2007, based on dates proposed by the licensee.

The licensee admitted to permitting a drunken patron on the premises and exceeding the licensed capacity limit of 80 persons.

The Registrar of Alcohol and Gaming issued a Notice of Proposal to revoke the liquor licence of 1252378 Ontario Inc., operating as SIN.

Following inspections, the licensee was found to have undertaken unauthorized renovations, operated as a night club in contravention of zoning by-laws, failed to make light meals available, and advertised liquor improperly.

At the hearing, the licensee admitted to the breaches through an Agreed Statement of Facts.

The Board accepted a Joint Submission on Disposition, ordering a minimum 21-day suspension of the licence, which would continue until the Registrar approved the boundary alterations.

The Board also attached conditions requiring the licensee to maintain seating for 120 patrons and prohibiting the premises from operating as a night club.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of Sorrento Café (2005) Inc. for overcrowding and permitting a patron to remove liquor from the licensed premises.

The matter proceeded by way of an Agreed Statement of Facts and a Joint Submission on Disposition.

The Board accepted the joint submission and ordered a 10-day suspension of the licensee's liquor licence.

The Registrar issued a Notice of Proposal to revoke the liquor licence of Ruby Matilda Wright, operating as Stephanie’s Caribbean Cuisine, and to refuse the transfer of the licence to Stephanie’s Caribbean Cuisine Inc. The Board found multiple serious violations of the Liquor Licence Act, including providing false information, contracting out the sale of liquor, and financial irresponsibility.

The evidence demonstrated that the licensee allowed her daughter to effectively operate the business and failed to ensure compliance with the Act.

Concluding that the licensee lacked the ability to operate the business with honesty, integrity, and due diligence, the Board ordered the immediate revocation of the liquor licence.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of La Molisana Café for permitting unlawful gambling on the premises.

The licensees admitted that an illegal poker game was underway in the licensed premises, violating subsection 45(1) of Ontario Regulation 719/90.

The Board accepted a joint submission on disposition, ordering a three-day suspension of the liquor licence and adding a condition prohibiting games of chance or mixed skill and chance, including card games, on the premises.

The Registrar issued a Notice of Proposal to suspend the liquor licence of the corporate licensee for allegedly exceeding the capacity of its patio.

An inspector observed 29 people on the patio, which had a licensed capacity of 20.

The licensee argued that the capacity should have been 28 based on a 1999 building department letter and that the licence contained an error.

The Board found that the licence clearly stated a capacity of 20 and that the licensee had failed to rectify any alleged error.

The Board concluded that the licensee violated section 43 of Ontario Regulation 719/90 and invited written submissions on disposition.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of Ridgelane Holdings Inc., operating as The Frog & Firkin, alleging the licensee permitted drunkenness on the premises.

The parties proceeded by way of an Agreed Statement of Facts and Joint Submission on Disposition, wherein the licensee admitted to the breach.

The Board accepted the joint submission and ordered a 7-day suspension of the liquor licence.

The Board of the Alcohol and Gaming Commission of Ontario previously ordered a 7-day suspension of the liquor licence for Dimmi Trattoria & Bar.

The licensee appealed the decision and obtained a stay, but later withdrew the appeal on consent.

The Board issued this order setting the suspension dates from April 1, 2007, to April 8, 2007, as proposed by the licensee.

The Registrar of the Alcohol and Gaming Commission of Ontario proposed to suspend the licensee's liquor licence.

The licensee admitted that patrons smoked marijuana in the licensed area of a catered event, violating subsection 45(2) of Regulation 719/90.

The Board accepted the joint submission, ordering a five-day suspension of the liquor licence and the immediate surrender of the licensee's catering endorsement.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to revoke the liquor licence of the corporate licensee on the basis that it had ceased operating its business.

The principal of the licensee confirmed the business had ceased operations eight months prior, but had delayed surrendering the licence due to ongoing lease negotiations with the landlord.

The Board found that the business had ceased operations and ordered the immediate revocation of the liquor licence pursuant to section 56 of Ontario Regulation 719/90.
