O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a hearing on February 2, 2006 pursuant to a Notice of Proposal to suspend the liquor licence dated May 31, 2005, issued to Mikos Hotels Limited, for premises operating as Royal Hotel at 171 Brock Street North, Whitby, Ontario, L1N 4H3, licence number 10066;
AND WHEREAS in its decision of April 27, 2006 the Board found that the licensee had breached subsection 45(2) of Ontario Regulation 719/90, and in its decision of May 11, 2006, the Board ordered a liquor licence suspension for twenty-eight (28) consecutive days;
AND WHEREAS the licence holder filed an appeal with the Ontario Superior Court of Justice (Divisional Court) and by an order dated July 7, 2006, the Court stayed the period of suspension of the licence pending the outcome of the appeal;
AND WHEREAS the appeal was dismissed by the Divisional Court by an order issued on April 24, 2007;
AND WHEREAS the licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the liquor licence issued to Mikos Hotels Limited for premises operating as ROYAL HOTEL at 171 Brock Street North, Whitby, Ontario, L1N 4H3, licence number 10066, be SUSPENDED for TWENTY-EIGHT (28) consecutive days to COMMENCE at 11:00 a.m. on July 2, 2007, and CONTINUE until 2:00 a.m. on July 30, 2007.
