AND IN THE MATTER OF THE LIQUOR LICENCE OF
1354748 ONTARIO INC. OPERATING AS DIMMI TRATTORIA & BAR, 140 CUMBERLAND STREET, TORONTO LICENCE NUMBER 804836
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a hearing on May 8, 2006 pursuant to a Notice of Proposal dated January 18, 2006 to suspend the liquor licence issued to 1354748 Ontario Inc. for premises operating as Dimmi Trattoria & Bar, 140 Cumberland Street, Toronto, Ontario, M5R 1A8, licence number 804836;
AND WHEREAS in its decision of June 6, 2006, the Board found that the licensee had breached section 43 of Ontario Regulation 719/90 under the Liquor Licence Act;
AND WHEREAS the Board ordered a seven (7) day suspension of the liquor licence;
AND WHEREAS the corporate licensee, through its counsel, appealed the Board’s decision to the Ontario Divisional Court and, obtained a stay of the Board’s order on September 27, 2006, which appeal was withdrawn on consent March 9, 2007;
AND WHEREAS the licensee has now proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the liquor licence issued to 1354748 Ontario Inc. for premises operating as Dimmi Trattoria & Bar, 140 Cumberland Street, Toronto, Ontario, M5R 1A8, licence number 804836 be SUSPENDED for seven (7) consecutive days to COMMENCE at 11:00 a.m. on April 1, 2007 and continue until 2:00 a.m. on April 8, 2007.
