The Ontario Securities Commission held a hearing to consider a proposed Settlement Agreement between Staff and Brian H. Crombie, former CFO of Biovail Corporation.

Crombie admitted to acquiescing in improper accounting practices regarding revenue recognition, disseminating materially inaccurate information concerning a truck accident, and providing misleading information to Staff during a continuous disclosure review.

The Commission approved the Settlement Agreement, finding it in the public interest.

Crombie was reprimanded, banned from acting as a director or officer of a reporting issuer for eight years, ordered to pay an administrative penalty of $250,000, and ordered to pay $50,000 in costs.

The College of Nurses of Ontario alleged that the Member misappropriated narcotics, falsified documentation, and failed to meet standards of practice regarding the handling and administration of Demerol and Morphine.

Following a hearing, the Discipline Committee found that the College failed to meet the standard of proof required.

The evidence presented was largely circumstantial and relied on inferences rather than facts.

The Committee concluded that the evidence was not clear, cogent, and convincing, and dismissed all allegations of professional misconduct against the Member.

The College of Nurses of Ontario brought disciplinary proceedings against a registered nurse for allegedly abusing a patient physically, verbally, and emotionally, and for misappropriating property by claiming sick leave pay from one employer while working a shift for another.

The Discipline Committee found the nurse guilty of verbal and emotional abuse, as well as misappropriation of property, but found the evidence insufficient to prove physical abuse.

The nurse's certificate of registration was suspended for four months, and she was ordered to complete a rehabilitation program and pay costs of $1,500.

The College of Nurses of Ontario alleged that the member verbally and physically abused a client.

During the hearing, the College's key witness gave inconsistent testimony during cross-examination and became unwilling to continue.

The College requested that the allegations be dismissed as it could no longer meet the standard of clear, cogent, and convincing evidence.

The panel dismissed the allegations.

The member subsequently sought costs, arguing the prosecution was unwarranted.

The panel denied the costs request, finding that the proceedings were reasonably justified based on initial eyewitness evidence.

The member, a teacher, pleaded guilty to professional misconduct after being convicted criminally for helping to harvest marijuana with an approximate resale value of $260,000.

The Discipline Committee accepted an agreed statement of facts and a joint submission on penalty.

The member's teaching certificates were suspended for two years, and he was ordered to receive a written reprimand and to report any future criminal charges.

The Ontario College of Teachers brought discipline proceedings against a member for professional misconduct, including allegations of sexual abuse of a student.

The member did not attend the hearing but signed an Agreed Statement of Facts and a plea of no contest, admitting to engaging in sexual intercourse with a student and other inappropriate conduct.

The Discipline Committee found the member guilty of professional misconduct and ordered the immediate revocation of his Certificate of Qualification and Registration.
