The Alcohol and Gaming Commission of Ontario issued an order setting the dates for a 10-day suspension of the liquor licence held by VN Spring Rolls Inc., operating as BABY BLUE.

The Board had previously found the licensee in breach of section 29 of Ontario Revised Regulation 719/90 and ordered the suspension.

The suspension was ordered to commence on August 17, 2008, and end on August 27, 2008.

The Licensee was found to have contravened section 29 of Ontario Regulation 719/90 by failing to clear signs of service by 2:45 a.m.

The Registrar sought a 10-day suspension, noting a prior 7-day suspension for the same offence in 2006.

The Licensee sought a 3 to 5-day suspension.

The Board ordered a 10-day suspension of the liquor licence, finding that a shorter suspension would be inadequate given the seriousness of the infraction and the need for specific and general deterrence.

An AGCO inspector testified that a male patron exhibited signs of intoxication, including slurred speech, bloodshot eyes, and weaving on his stool.

The licensee's employees testified that the patron was not intoxicated, but rather had a heavy Newfoundland accent, was tired after a 12-hour shift, and was merely adjusting his position.

The Board found the employees' evidence credible and concluded that the Registrar failed to establish on a balance of probabilities that the patron was drunk.

The allegation was dismissed.

The Licensee requested an amendment to the dates of a 10-day liquor licence suspension previously ordered by the Board.

The Registrar consented to the proposed amendment.

The Board issued an amending order, changing the suspension dates to commence on July 29, 2008, and continue until August 8, 2008.

The Board found that the Licensee breached section 29 of the regulations by failing to clear signs of service by 2:45 a.m., which the Licensee admitted.

However, the Board dismissed the allegation of serving liquor after 2:00 a.m., finding insufficient evidence that unopened cold beer was served after the deadline.

The Board also dismissed the allegation of permitting disorderly conduct, concluding that while three patrons directed offensive verbal abuse at the liquor inspectors, the conduct did not involve violence or threats and was not extreme enough to qualify as quarrelsome or disorderly conduct under the regulation.

The Board invited written submissions on penalty.
