The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the respondent establishment, alleging violations of the Liquor Licence Act regulations and breaches of specific licence conditions.

The allegations included permitting drunkenness on the premises and failing to adhere to conditions restricting patron ingress/egress to the front doors and prohibiting line-ups in the adjacent alleyway.

The Board found that the evidence established breaches of the regulation regarding intoxicated patrons and clear violations of the licence conditions regarding door usage and line-ups.

The Board invited written submissions on penalty.

The Board previously ordered a 10-day suspension of the liquor licence for 6161251 Canada Inc. operating as Shot House Pub after finding a breach of the Liquor Licence Act regulations.

The Licensee proposed acceptable suspension dates.

The Board ordered the 10-day suspension to commence on May 20, 2008, and continue until May 30, 2008.

The Registrar issued a Notice of Proposal to suspend the respondent's liquor licence for alleged violations of the Liquor Licence Act and its regulations, specifically serving an intoxicated person and permitting drunkenness and violent conduct.

A patron consumed approximately 15-16 alcoholic beverages over four hours, became highly intoxicated, and was subsequently pushed off an elevated dance floor, sustaining a head injury.

The tribunal found the eyewitness testimony credible and sufficient to establish that the patron was intoxicated, was served alcohol while intoxicated, and was assaulted on the premises.

The tribunal concluded that the licensee violated section 29 of the Act and subsection 45(1) of the Regulation.

The Registrar issued a Notice of Proposal to suspend the licensee's liquor licence for 21 days for allegedly permitting drunkenness on the premises.

An AGCO inspector observed four patrons exhibiting signs of intoxication.

The Board found that two of the patrons were drunk and that the licensee failed to take adequate steps to promptly remove them, thereby permitting drunkenness contrary to subsection 45(1) of O. Reg. 719/90.

A city councillor, representing resident objectors, opposed the application.

At the hearing, the parties agreed to a set of conditions to be placed on the licence, including capacity limits, noise restrictions on the outdoor patio, and security patrol requirements.

Based on this agreement, the objectors withdrew their opposition, and the Board ordered that the liquor sales licence be issued subject to the agreed conditions.
