The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal alleging that the licensee permitted drunkenness on its premises on two separate dates, contrary to subsection 45(1) of Ontario Regulation 719/90.
On the first date, an intoxicated patron was served alcohol and later re-entered the premises while police were present.
The Board found a breach for the patron's first attendance but dismissed the allegation regarding the second attendance, as staff were occupied with police and could not reasonably remove him.
On the second date, an intoxicated patron was assaulted outside the premises after drinking inside.
The Board found sufficient evidence that the patron was drunk in the premises and found a breach.
Written submissions on penalty were invited.
