Allegations
A hearing into a Notice of Proposed Order number 135364 dated December 14, 2007 to suspend the registration of MARK DAVID SUGARMAN, 167 Atherly Road, Apartment 5, Orillia, Ontario, L3V 2C3 as a gaming assistant, registration number 128324, was held on February 5, 2008 in the City of Orillia.
The Registrant appeared on his own behalf and waived his right to legal representation
Before the Board, and on the Gaming Hearing Request Form, the Registrant admitted to the allegations contained in the Notice of Proposed Order which stated that Mr. Sugarman had failed to file a payment plan to settle outstanding fines to the courts.
Based on the admissions, the Parties jointly submitted that the Board accept the two (2) week suspension as proposed in the Notice of Proposed Order with the following conditions:
a) a payment plan will be submitted to the Deputy Registrar by March 30,
2008; and
b) registration renewal as a gaming assistant is due March 30, 2008, and is
conditional upon acceptance of the payment plan.
Order
Therefore, based on the Registrant's admissions, the Board confirms the Proposed Order of the Deputy Registrar, and DIRECTS that the registration of MARK DAVID SUGARMAN, 167 Atherly Road, Apartment 5, Orillia, Ontario, L3V 2C3, registration number 128324, be SUSPENDED for FOURTEEN (14) days. The registrant has until February 12, 2008 to propose dates of suspension after which the dates will be determined by the Registrar’s Representative without further consultation.
Further, the Board ORDERS the following condition with respect to renewal of the registration; Mr. Sugarman consented:
a) a payment plan will be submitted to the Deputy Registrar by March 30,
2008; and
b) registration renewal as a gaming assistant is due March 30, 2008, and is
conditional upon acceptance of the payment plan.
