Following a finding that the licensee permitted drunkenness on its premises in violation of subsection 45(1) of Ontario Regulation 719/90, the Board held a hearing to determine the appropriate sanction.

The Registrar sought a 25 to 28-day suspension, citing the licensee's history of similar infractions and failure to implement proactive due diligence measures.

The licensee requested a more lenient sanction, pointing to recent corrective actions.

The Board found the licensee's corrective measures to be reactive and, given the seriousness of the contravention and the licensee's history of three prior similar violations, ordered a 25-day suspension of the liquor licence to achieve specific and general deterrence.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the establishment known as Wicked Club, alleging a violation of subsection 45(1) of the Liquor Licence Act for obstructing an inspector.

During a routine inspection, the licensee and manager attempted to prevent inspectors from accessing the unlicensed third floor of the premises, which was used as a swingers club.

The Board found that the licensee did prevent an inspector from entering the area, either verbally or physically, and rejected the defence that the licensee was unaware inspectors could inspect unlicensed areas of the premises.

The Board concluded that the licensee violated subsection 45(1) of the Act and invited written submissions on penalty.

The Licensee requested an amendment to a previously ordered 20-day liquor licence suspension to allow it to hold a charity event on December 6, 2008.

With the consent of the Registrar, the Board ordered that the suspension be lifted for that day and that the Licensee serve the remaining day of the suspension on December 28, 2008.
