AMENDED O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission ("AGCO") held a hearing on April 15, 2008, pursuant to Notice of Proposal number 15849 dated December 13, 2007, to suspend liquor licence number 90105 issued to El Mocambo Rocks Inc., (the "Licensee"), operating as EL MOCAMBO ROCKS, 464 Spadina Avenue, Toronto, Ontario, M5T 2G8;
AND WHEREAS in its decision of August 15, 2008, the Board found that the Licensee had breached section 29 of the Liquor Licence Act ("LLA") and subsections 25(1), 34(1) and 45(1) of the Ontario Revised Regulation 719/90 made pursuant to the LLA;
AND WHEREAS in its Order of October 16, 2008 (the "Suspension Order"), the Board ordered a TWENTY (20) day suspension of the liquor licence to COMMENCE at 11:00 a.m. on November 30, 2008 and continue until 2:00 a.m. on December 20, 2008;
AND WHEREAS the Licensee has requested that the suspension order be lifted from 11:00 a.m. on December 6, 2008 to 2:00 a.m. on December 7, 2008 in order to hold a charity event, Blank-Fest, and the Registrar's representative has consented to the proposed amendment. In lieu thereof, the Licensee and Registrar agree a suspension should be served from 11:00 a.m. on December 28, 2008 to 2:00 a.m. on December 29^th^, 2008;
AND WHEREAS the amended suspension dates are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the Suspension Order be lifted from 11:00 a.m. on December 6, 2008 to 2:00 a.m. on December 7, 2008 (only) and, in lieu thereof, the liquor licence number 90105 issued to El Mocambo Rocks Inc., operating as EL MOCAMBO ROCKS, 464 Spadina Avenue, Toronto, Ontario, M5T 2G8, shall be SUSPENDED from 11:00 a.m. on December 28, 2008 to 2:00 a.m. on December 29, 2008.
