The applicant sought statutory accident benefits following a motor vehicle accident.
The respondent denied several treatment plans and assessments on the basis that the applicant's injuries fell within the Minor Injury Guideline (MIG).
The Tribunal found that the applicant failed to prove his injuries, including alleged post-concussion syndrome and degenerative disc disease, warranted removal from the MIG.
The Tribunal also held that the respondent's denial notices contained sufficient medical reasons, meaning the applicant was not entitled to the plans under section 38(11) of the Schedule.
The application was dismissed.
