The accused was charged with second-degree murder, pointing a firearm, and unauthorized possession of firearms after fatally shooting a man who had aggressively approached his home following a series of altercations.

The victim, who was highly intoxicated and angry, had repeatedly rammed the accused's vehicle with his truck and approached the accused's door brandishing a stick.

The accused, who was inside his home, fired a single shot through the door, killing the victim.

The court found that the Crown failed to prove beyond a reasonable doubt that the accused was not acting in self-defence, resulting in an acquittal on the murder and pointing a firearm charges.

The accused was found guilty of unauthorized possession of firearms.

In a trial for second-degree murder, the Crown applied to admit statements made by the accused to police, while the accused sought to exclude them under the Charter.

The accused argued his statements were involuntary due to police inducements, his right to counsel was breached because his consulted lawyer had an unknown conflict of interest, and he was arbitrarily detained at the police station after a warrant of remand was signed.

The court found the statements were voluntary, the right to counsel was not breached as the state played no role in the conflict, and although the continued detention at the police station was arbitrary, the breach was not serious enough to warrant exclusion under section 24(2) of the Charter.

The statements were ruled admissible.

The appellant, Ryan Luckese, appealed his conviction for assault with a weapon.

The appeal grounds were that the trial judge erred by failing to address the issue of consent and, alternatively, erred in rejecting the defence of self-defence.

The Superior Court dismissed the appeal, finding that the trial judge implicitly considered consent by accepting the complainant's evidence of being threatened and taking defensive action.

The court also found that the trial judge correctly determined that self-defence under Section 34 of the Criminal Code did not apply, as the appellant initiated the threat with the axe before the complainant acted.

A young person was charged with theft of a dirt bike valued at approximately $2,000 under section 334(b) of the Criminal Code.

The bike was stolen from the Mohawk Bay of Quinte Territory on or about September 26, 2017, and was recovered several days later in a severely damaged condition.

The Crown's case relied on testimony from witnesses who claimed the accused admitted to giving the bike to another youth.

However, the court found significant inconsistencies and credibility issues in the Crown's witness testimony, including contradictory statements about how the bike was obtained, material inconsistencies between police statements and trial testimony, and evidence of motive to fabricate.

The accused testified and denied both stealing the bike and giving it to anyone.

The court acquitted the accused, finding that the Crown had failed to prove guilt beyond a reasonable doubt.

The offender pleaded guilty to impaired driving causing death after a collision that killed the victim.

The offender, a 34-year-old first-time offender who worked as a correctional officer and volunteer firefighter, was speeding and highly intoxicated at the time of the crash.

The court emphasized denunciation and general deterrence, sentencing the offender to 5 years in penitentiary and a 5-year driving prohibition.

Following a 19-day trial, the accused was convicted of 60 firearms and weapons offences, including possession of prohibited and restricted firearms with readily accessible ammunition, breach of prohibition orders, unsafe storage of firearms, and possession of firearms with removed serial numbers.

The accused, a former RCMP officer and convicted gun trafficker on federal parole, was arrested after police executed a high-risk search warrant and seized 67 firearms, prohibited devices, thousands of rounds of ammunition, and explosives from his residence.

The court imposed a global sentence of 7 years 9 months (resulting in 6 years after pre-trial custody credit), with consecutive sentences for breach of prohibition orders.

The court also granted a 3-month sentencing remission as a remedy for the accused's unlawful detention for 15 days without being brought before a judicial officer, which constituted an abuse of process and breach of the Canadian Charter of Rights and Freedoms.

A 57-year-old retired RCMP officer was charged with 60 firearm and weapons offences following a search warrant execution at his residence.

The court found the search lawful and the seizure of 67 firearms, prohibited weapons, and explosives justified.

However, the court found serious Charter breaches: the accused was unlawfully detained for 15 days without being brought before a justice, in violation of section 503 of the Criminal Code and sections 7 and 9 of the Charter.

The court also found a breach of section 8 rights regarding the destruction of commercial explosives without judicial authorization.

Despite these breaches, the court convicted the accused on 60 counts, excluding evidence derived from the unlawful detention and imposing a sentencing remission as remedy.

At a preliminary inquiry into the death of Shane Stone, the Crown sought committal of three accused on charges of second degree murder.

The victim was beaten to death in the accused's bedroom on January 2, 2013.

One accused conceded committal.

The court found sufficient evidence to commit the other two accused to trial on second degree murder, with one accused also facing charges of accessory after the fact and robbery.

The decision turned on circumstantial evidence including DNA findings, forensic evidence, witness testimony, and cell phone records establishing presence and participation in the assault.

The Crown applied to admit evidence of prior discreditable conduct by two of the accused relating to an assault on November 23, 2011, to support a committal on a charge of second degree murder.

One accused conceded committal, but the other objected.

The court found that while some similarities existed between the prior assault and the charged offence, most were generic in nature and present in countless assault cases.

The court held that the probative value of the similar fact evidence was limited and did not outweigh the risk of prejudice.

The Crown's reasoning essentially sought to establish that the accused was the "type of person" who commits serious assaults, which is prohibited reasoning.

The application was dismissed.

The accused, a young person at the time of the alleged offences, was charged with three counts of sexual assault against a younger male cousin for incidents occurring between 1999 and 2005.

A voir dire was held to determine the admissibility of statements made by the accused to police prior to and following his arrest.

The court found that the police breached the accused's Charter rights by failing to obtain a warrant before entering the accused's home to effect an arrest, misleading the accused about the existence of a warrant, and deliberately delaying the provision of the right to counsel.

The court excluded all statements made by the accused as inadmissible evidence.
