Police officer's appeal of 15-day pay forfeiture for off-duty drinking and driving in cruiser dismissed.

The appellant police officer appealed a disciplinary penalty of 15 days' forfeiture of pay for discreditable conduct.

The officer had consumed alcohol while on duty, booked off duty, continued drinking, and then drove an unmarked police cruiser with unauthorized passengers, resulting in a collision and a failed roadside screening test.

The Ontario Civilian Police Commission upheld the penalty, finding that while the officer had an exemplary record, the penalty was within the acceptable range given the serious nature of the misconduct and the need for general deterrence regarding drinking and driving.

Town of Tecumseh and Tecumseh Police Services Board v. St. Clair Beach Police Service, 2000 ONCPC 4001

Abolition of municipal police service approved subject to increasing the proposed OPP officer complement.

The Town of Tecumseh and the Tecumseh Police Services Board applied to the Ontario Civilian Commission on Police Services for consent to abolish the St. Clair Beach Police Service and contract policing to the Ontario Provincial Police.

The Commission reviewed the proposed staffing, deployment, facilities, and transition plans.

Finding the proposed officer-to-population ratio lower than comparable municipalities, the Commission approved the abolition subject to conditions, including the addition of three front-line officers and the completion of a new police facility.

Memis Sipar v. Detective John Schertzer et al., 1999 CanLII 31608

Police prosecutor is a proper party to an appeal; 30-day appeal period runs from written notice.

The applicant sought leave to appeal a Hearing Officer's decision dismissing disciplinary charges against several police officers.

The respondents raised preliminary motions arguing that the chief of police's prosecutor was not a proper party to the appeal and that the appeal was filed outside the 30-day limitation period under section 70(1) of the Police Services Act.

The Ontario Civilian Police Commission held that the prosecutor is a proper party to the appeal.

The Commission also found that the appeal was filed within the 30-day period, as the time began to run when the applicant received written notice of the decision, not when he was verbally informed.

The preliminary motions to dismiss were denied.

Guelph Police Services Board v. City of Guelph, 1999 ONCPC 3901

Commission authorizes most disputed police budget expenditures for staffing and equipment, finding them necessary for adequate policing.

The Guelph Police Services Board requested a hearing under section 39(5) of the Police Services Act after the City of Guelph reduced its proposed 1999 budget by $252,000.

The Board argued the funds were necessary to hire additional staff, cover overtime, and meet new provincial standards, while the City contended the approved budget was sufficient given past surpluses and under-spending.

The Commission authorized most of the disputed expenditures, including funds for court security, traffic enforcement, data entry, and Y2K compliance, but disallowed the hiring of one general duty officer and an unexplained miscellaneous expense.

County of Wellington (Re), 1999 ONCPC 4003

Consent granted to abolish three municipal police services in Wellington County in favour of OPP policing.

The County of Wellington applied to the Ontario Civilian Commission on Police Services under section 40 of the Police Services Act for consent to abolish the municipal police services of Fergus, Harriston, and Palmerston, transitioning to an integrated Ontario Provincial Police (OPP) contract.

The Commission reviewed the proposed staffing, facilities, communications, and equipment, concluding that the OPP arrangement would provide adequate and effective police services.

The Commission granted consent for the abolishment effective September 7, 1999, and ordered that any unresolved severance issues between the Board and the police associations proceed to arbitration if not settled within 45 days.

Constable David Deviney v. Toronto Police Service, 1999 CanLII 31612

Police officer's conviction and 15-day forfeiture penalty for using racial slurs upheld on appeal.

The appellant police officer appealed a conviction for discreditable conduct and the resulting penalty of forfeiture of 15 days off.

The conviction arose from a telephone conversation in which the appellant used racially offensive language.

The Commission upheld the Hearing Officer's credibility findings, concluding they were not void of evidentiary foundation.

The Commission also upheld the penalty, finding it was within the appropriate range for serious misconduct involving racial slurs, despite the appellant's exemplary prior record.

Woodstock (City) et al. (Re), 1998 ONCPC 4006

Amalgamation of Woodstock, Norwich, and Tavistock police services into the Oxford Community Police Service approved.

The City of Woodstock and the Townships of Blandford-Blenheim, East Zorra-Tavistock, and Norwich applied to the Ontario Civilian Commission on Police Services for consent to amalgamate the police services of Woodstock, Norwich, and Tavistock into a new Oxford Community Police Service.

The Commission reviewed the proposed staffing, facilities, communications, equipment, budget, and transition plans.

Despite public concerns regarding the process and a preference for retaining the OPP in rural areas, the Commission found the proposal sound and capable of providing adequate and effective policing.

The amalgamation was approved, with the effective date set for February 1, 1999, to allow for proper transition planning.

Sergeant Ronald Delano v. Niagara Regional Police Service, 1998 CanLII 27138

Police officer's appeal of dismissal for theft and deceit dismissed; medical evidence did not excuse misconduct.

The appellant, a police sergeant with 26 years of service, appealed a penalty of dismissal imposed after he pled guilty to seven counts of misconduct, including corrupt practice, deceit, and discreditable conduct.

The misconduct involved taking a shotgun and a knife from members of the public, failing to place them in the property system, and submitting false reports to cover up his actions.

The appellant argued that the hearing officer failed to properly consider medical evidence of his long-standing depression.

The Commission dismissed the appeal, finding that the hearing officer correctly weighed the medical evidence and that the appellant's actions constituted an absolute misuse of his position of trust, warranting dismissal.

Gateman v. London Police Service, 1998 CanLII 27142

Police disciplinary guilty pleas set aside and new trial ordered due to inadequate representation by agent.

The appellant police officer appealed findings of discreditable conduct and corrupt practice arising from guilty pleas entered at a disciplinary hearing.

He sought to withdraw the pleas, arguing they were the result of undue pressure and incompetent representation by his agent, who admitted facts the appellant did not accept.

The Commission admitted the appellant's affidavit as new evidence to assess the validity of the hearing process.

Finding that the agent had admitted key facts without the appellant's agreement and that the Hearing Officer would not have accepted the pleas had this been known, the Commission concluded the appellant was inadequately represented.

The appeal was allowed and the matters remitted for a new trial.

The Regional Municipality of Haldimand-Norfolk applied to the Ontario Civilian Commission on Police Services for consent to abolish the Haldimand-Norfolk Regional Police Service and replace it with contract policing by the Ontario Provincial Police (OPP).

The Commission reviewed the proposed staffing, deployment, facilities, communications, and equipment to determine if the new arrangement would provide adequate and effective police services under the Police Services Act.

Finding that the proposed OPP integration maintained historical deployment levels and provided appropriate infrastructure, the Commission concluded the arrangement was adequate.

As severance agreements or consents to arbitration were in place for all members, the Commission granted consent to abolish the municipal police service.

Consent granted to abolish four municipal police services to create the amalgamated Chatham-Kent Police Service.

The Municipality of Chatham-Kent applied to the Ontario Civilian Commission on Police Services under section 40 of the Police Services Act for consent to abolish the municipal police services of Chatham, Tilbury, Wallaceburg, and Dresden.

This abolition was proposed to establish a single new Chatham-Kent Police Service following the amalgamation of 22 communities into a single-tier municipality.

The Commission reviewed the comprehensive proposal developed by a Policing Task Force, which included detailed plans for staffing, facilities, communications, equipment, and budget.

The Commission found that the proposed arrangement would provide adequate and effective police services, noting that all existing municipal officers and civilian staff would be offered employment with the new service, thereby satisfying severance requirements.

The Commission granted consent to the abolition, effective in two phases, subject to the submission of a final report on implementation details.

Consent granted to abolish Hawkesbury Police Service in favour of OPP contract policing.

The Town of Hawkesbury applied to the Ontario Civilian Commission on Police Services for consent to abolish its municipal police service and enter into a contract with the Ontario Provincial Police (OPP) for policing services.

The Commission reviewed the proposed integrated detachment model, staffing levels, equipment, dispatching, and facilities.

Finding that the proposal would provide adequate and effective police services and that severance arrangements were satisfactory, the Commission consented to the abolition, conditional upon the finalization of the facility lease and renovation contracts.

Town of Leamington and Township of Mersea (Re), 1998 ONCPC 4002

Amalgamation of Leamington and Mersea Township Police Services approved to provide adequate and effective policing.

The Town of Leamington and the Township of Mersea applied to the Ontario Civilian Commission on Police Services for approval to amalgamate their respective police services into a single force, the Leamington Mersea Police Service.

The Commission reviewed the proposal, noting the impending municipal consolidation, the efficiencies of a single service, and the broad public and institutional support.

Finding that the amalgamation would provide adequate and effective policing and that the agreement met the requirements of section 6(2) of the Police Services Act, the Commission approved the amalgamation effective July 1, 1998.

Constable Michael McClory v. Hamilton-Wentworth Regional Police Service, 1998 CanLII 27135

Police discipline convictions revoked due to Hearing Officer's ex parte communication and lack of independent legal advice.

The appellant police officer appealed convictions for discreditable conduct and insubordination.

During the original disciplinary hearing, the Hearing Officer communicated directly with the prosecutor's counsel regarding process in the absence of the officer's representative.

When challenged, the Hearing Officer sought legal advice from a lawyer employed by the same regional municipality as the prosecutor's counsel.

The Commission found that the ex parte communication contravened section 69(13) of the Police Services Act and that the legal adviser was not independent as required by section 69(14).

The convictions and dispositions were revoked and the matter remitted for a new hearing.

Town of Kemptville (Re), 1998 ONCPC 4001

Commission consents to abolition of Kemptville Police Service to allow for OPP policing contract.

The Town of Kemptville applied to the Ontario Civilian Commission on Police Services for consent to abolish the Kemptville Police Service.

Following municipal amalgamation into the Township of North Grenville, the Town proposed contracting policing services to the Ontario Provincial Police (OPP).

The Commission found that the proposed OPP contract would provide adequate and effective policing, offering improved services and specialized resources.

As severance arrangements for the single terminated employee were satisfactory and outstanding matters with the Chief were agreed to be arbitrated if necessary, the Commission consented to the abolition.

Wayne Tremble (Re), 1998 ONCPC 2501

Deputy Chief demoted to Inspector for two years due to unsatisfactory work performance and communication issues.

Following an inquiry into the Belleville Police Force, the Ontario Civilian Commission on Police Services found that the Deputy Chief was incapable of performing his duties satisfactorily.

The Divisional Court upheld the findings but remitted the matter of penalty to the Commission to allow the Deputy Chief to make submissions.

After considering the submissions, the Commission ordered that the Deputy Chief be demoted to the rank of Inspector for a minimum of two years and undergo practical instruction to improve his oral communication skills.

Staff Inspector Edward Hegney v. Metropolitan Toronto Police Service, 1998 CanLII 27139

Motion for extension of time to appeal disciplinary finding denied due to lack of reasonable excuse for delay.

The appellant, a police officer, sought an extension of time to appeal a disciplinary finding of insubordination.

The motion was filed before legislative amendments repealed the Commission's power to grant such extensions, but heard after the amendments took effect.

The Commission found it had authority to hear the motion based on the law at the time of filing.

However, the Commission denied the extension, finding that despite arguable grounds for appeal, the appellant failed to demonstrate a bona fide intention to appeal to the Commission within the time limit and offered no reasonable excuse for the substantial delay.

Town of Goderich (Re), 1997 ONCPC 4005

Consent granted to abolish municipal police service after town provided adequate storefront accommodation plan.

The Town of Goderich applied for consent to abolish its municipal police service in order to contract with the Ontario Provincial Police.

The Commission previously withheld consent due to concerns about the lack of a visible local police office.

The Town subsequently provided a detailed plan, budget, and lease for a centrally located storefront community policing office.

Satisfied that the new accommodation plan met the community's needs, the Commission granted consent to abolish the municipal police service.

Towns of Hanover and Walkerton (Re), 1997 ONCPC 4004

Amalgamation of Hanover and Walkerton police services and related civilian staff terminations approved.

The Towns of Hanover and Walkerton applied to the Ontario Civilian Commission on Police Services for approval to amalgamate their respective police services and to terminate certain civilian dispatch staff to reduce the size of the new service.

The Commission reviewed the proposed amalgamation agreement, which included the creation of a joint board, consolidation of dispatch services, and retention of all uniformed officers.

Finding that the amalgamation would provide adequate and effective policing and that the requirements for severance agreements with the affected civilian staff had been met, the Commission approved the amalgamation and consented to the terminations.
