The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposed Order to revoke the registration of the Registrant as a lottery retailer.

The matter was resolved at the hearing when the Registrar withdrew the notice after the Registrant agreed to the inclusion of specific conditions on its registration.

The Board ordered the agreed-upon conditions attached to the registration, which required a specific officer and director to remove himself from the corporation and cease direct involvement in its day-to-day operations.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the licensee's liquor licence for serving intoxicated patrons.

The Board ordered the Licensee to comply with the conditions and maintained the order lifting the suspension.

A pre-hearing conference was held regarding a Notice of Proposal to suspend the liquor licence of Dragon's Den Sports Bar.

The Board ordered the licensee to disclose its witness list and detailed summaries of witness evidence to the Registrar 10 days before the hearing.

The Registrar was also ordered to complete any further disclosure 10 days before the hearing.

The Registrar of the Alcohol and Gaming Commission of Ontario issued Notices of Proposal to suspend and revoke the liquor licence of the respondent licensee.

The parties submitted an Agreed Statement of Facts admitting that a patron was allowed to enter with a gun and fired shots, intoxicated patrons were permitted on the premises, and the licensee failed to comply with a security condition.

The Board accepted the joint submission and ordered a 60-day suspension of the liquor licence.

The Board previously found the Licensee contravened the Liquor Licence Act and regulations by selling and serving alcohol outside legislated hours and allowing beer to be removed from or brought onto the premises.

In this decision on sanction, the Registrar sought a 7 to 10-day suspension, while the Licensee denied the violations and argued against any suspension.

Noting the Licensee's lack of prior disciplinary history but failure to present a plan to prevent recurrence, the Board ordered a 7-day suspension of the liquor licence for specific and general deterrence.

The parties submitted an Agreed Statement of Facts admitting that the licensee served two intoxicated patrons, one of whom was later found deceased, and permitted drunken patrons on the premises on two other occasions.

The Board accepted the Joint Submission on Disposition and ordered a 35-day suspension of the liquor licence.

A pre-hearing conference was held regarding a Notice of Proposal concerning the liquor licence of Wrong Bar Inc. The Board granted party status to the City of Toronto on consent.

The Board ordered mutual disclosure of witness lists and evidence summaries between the Licensee and the Registrar by May 25, 2010, ahead of the scheduled hearing.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to refuse to renew the applicant's liquor delivery service licence.

The allegations included selling liquor to minors, failing to keep proper records, obstructing an inspection, and operating under an unauthorized name.

The Board found that the applicant's son, who was the sole employee and operator of the business, had delivered liquor to underage youths on the street without checking identification, and had subsequently falsified records to conceal the transaction.

Although the applicant had taken steps to improve record-keeping, the Board found that she was unable to adequately supervise her son, who had a history of criminal and driving offences.

Concluding that there were reasonable grounds to believe the business would not be carried on in accordance with the law and with integrity and honesty, the Board refused to renew the licence.

The Board issued an amended order setting new dates for a seven-day suspension of the liquor licence for Wally's Roadhouse.

The suspension was originally ordered in 2009 but was stayed pending an appeal to the Divisional Court.

Following the dismissal of the appeal, the licensee proposed new suspension dates which were accepted by the Board.

The Board found that the Licensee violated the rules against serving alcohol outside prescribed hours, permitting removal of liquor, and failing to facilitate an inspection.

The allegations of obstructing an inspection and allowing a patron behind the bar were dismissed.

The Registrar of the Alcohol and Gaming Commission of Ontario issued a Notice of Proposal to suspend the liquor licence of the Licensee for alleged violations of the Liquor Licence Act and its regulations.

An inspector observed patrons consuming beer in cups outside the establishment before 11:00 a.m. and encountered a lack of cooperation from the sole staff member on duty.

The Board found that the Licensee violated the regulations by selling and serving liquor outside prescribed hours and permitting the removal of liquor from the premises.

The Board also found a violation for failing to facilitate the inspection, but dismissed allegations of obstructing the inspection and permitting a patron behind the bar.

The Licensee appealed an Order of Monetary Penalty issued by the Registrar of the Alcohol and Gaming Commission of Ontario for allegedly permitting an intoxicated patron on the premises.

The Registrar relied on the testimony of a single patron who claimed to have witnessed an intoxicated male and reported him to staff.

The Board found the witness's evidence lacked credibility due to her admitted intoxication, involvement in a physical altercation, and animosity toward the Licensee.

Without corroborating evidence, the Board dismissed the alleged violation and set aside the $1,800 monetary penalty.

The Registrar issued a Notice of Proposal to suspend the Licensee's liquor licence for allegedly permitting drunkenness and failing to facilitate a police inspection.

Plainclothes police officers attended the premises near closing time and found the door locked.

After a brief delay, a patron opened the door.

The officers alleged the patron was intoxicated and that the locked door impeded their inspection.

The Board found that the patron's apparent signs of intoxication were attributable to a recent stroke, not alcohol consumption.

The Board also accepted that the door was locked for safety reasons due to recent robberies in the area, and that the brief delay in opening it did not constitute a failure to facilitate the inspection.

The allegations were dismissed.

Following a finding that the licensee violated section 43 of Ontario Regulation 719/90, the Board ordered an 18-day suspension of its liquor licence.

The licensee proposed suspension dates which were acceptable to the Board.

The Board ordered the suspension to commence on April 5, 2010, and continue until April 23, 2010.
